I've never posted, But have been watching this thread for quite awhile.
I'm really suprised these people tryed so hard, I thought everyone knew what "As is" meant.
Anyway I'm glad you finally found A portion of the legal system that remembers how its suposed to work.
I'll be selling one of my boats in the spring, And will be remembering this thread even before I even list it.

Hopefully this will be the first of many posts on a (from what I've seen) great forum board.

And don't think that we didn't note that little bit of sympathy for the poor kid in your tone -- even after all this. What it proves, is that you are a good guy to the core. Enjoy a free conscious and favourable winds, sir!

Congrats CB. I am rather surprised your lawyer didn't suggest a counter suit to cover your loses of having to go to court. But then I can also appresiate your feelings of wanting to get it over with.

Wooooooo Hooooooooo.....almost seems a little anti climatic; I too expected some more fireworks and another twist on this long tale...

Yes, I did just sell the Renken last weekend and yes, my bill of sale was signed by us both and AS IS was prominently displayed across the bottom of the page. I did follow up with the guy, however as he bought the boat here in Florida and towed it to Georgia, all in the same day. We checked things together and made sure the trailer was gone over more than once and he left with a big grin on his face. After finding the stern light and the manual for the fish finder I contacted him for his address to UPS him the parts. He had just come off his lake and was still pretty excited. I hope not to hear any horror stories from him...:)

Your story gives me hope. I'm sure that nobody on this site will believe me but I am involved in a case that actually has yours topped in ridiculousness, seriousness and length of time that it has been going on for. I know in my heart that the guy taking me to court has no case but that thought in the back of my head that my guy could somehow find a way to win causes me much stress and agony. I truly know what you just went through and sincerely want to say...

CONGRATULATIONS!!!!!!!!!

CB, I didn't mean to make you worry man. Really it was just a joke! The kid and momma didn't know to drop it way back when.... don't waste time waiting for the other shoe to fall. You're right..... RELAX!!!!

Congrats on the win.

Sounds like the kid spent more money on this case than he would have to just replace/repair the motor. Some people learn the hard way.

And his mom and/or whoever else might have encouraged him to seek remediation should be smacked in the head with a baseball bat.

You should also take the time to send the results of this trial to the first "judge" who heard the case and found for the kid. Rub their nose in the fact that they completely blew it. Point out that they failed miserably at their job and need to make major improvements in their performance to reach the minimum standards for their job. Also point out that because the judge has such poor decision skills they caused the kid to waste thousands of dollars. Send copies to their superiors.

I believe he can not appeal the decision. Only a defendant can appeal a 'guilty' verdict, otherwise, I think it falls into the category of being tried twice. If the claimant could appeal a loss, wouldn't Marcia Clark appealed OJ's not guilty verdict?

Don't give this anymore thought, and go enjoy life!!! :D

Congrats on the outcome. I too am in the middle of a case that involves appeal after appeal after appeal......but mine is in the unemployment court realm. So far we are on our 4th appeal. I think there is only one more to go.

Be cautious in gloating about winning a case to a judge you feel messed up. You nver know when you might meet that judge again in the court room. I am sure you already know that though......


Congrats and good riddens to a headache.

Judges has pretty much no accountability unless they screw up in a big political issue. What you suggest will just **** what we think is a bad judge. Can you imagine if CB had to go in front of that judge or any of his judges friends???

CB, I am so glad this is over for you. I also admire your sympathy towards this kid. That shows how much class and how much of a great human being you are. Although I would be inclined to take the kid to court to get some of my expenses back, even if just a few hundred, just to teach him a lesson on how it feels to be in the defendant side I admire that you dont. Some rocks are better left unturned. Good luck in whatever you do.

I just realized that I put out about 800 bucks out of my pocket (500 to lawyer and 300 to file the appeal), and the kid easily put out over 1500 bucks.

2300 spent and we are at the same place we were the day after he bought it. Stupid Stupid Stupid.

Well... if it were me, I'd feel better about spending $800 and feeling like I stood up for what was right rather than giving the guy any $$$ which would have reinforced his behavior of not taking responsibility for what happened to HIS boat.

Congrat's, it's good that it's over, and good job keeping your head on straight... many would've got very bent out of shape over stupidity such as this!

I'm not an attorney, and I don't play one on TV, but I think you are confusing criminal law with civil law. The rules are quite a bit different and no one is found guilty in a civil lawsuit. I think what happened here is that the judge ruled in CB's favor without trial (summary judgement) and dismissed the suit. Its sort of a formalized way of saying to the kid, "get out of my court, you twit. I don't have time for this nonsense!" There probably is another court to go to but the kid would have to be an idiot to try that avenue. Odds are that this thing is over.

I can think of some other descriptors, but not "idiot".
Does anyone who has read this thread believe that the kid was driving all this ?

Yeah, I felt a little funny using the word idiot, but that was in reply to the previous post where that word was used.

If he is old enough to make his own money and buy his own boat but still let's his mother pull the strings then what would you call it.
Actually it's probably better not to answer that I don't want to go off on to much of a tangent on this thread.:cool:
