Well, the kid stated his case. My lawyer asked him if the boat ran well during the test drive. "yes". He asked him if he knew he bought it without any warranty. "yes". and that if CB were to offer the boat with a warrranty he would have priced it differently. "yes"
He then turned to the judge and said "do I need to go any further? When CB sold the boat it was running fine. He wanted no respsibility for it once it changed hands. We don't know what happened on the lake the next day. It ran for 4-5 hours and then something happened. We don't know what that was. That's all I have"
The kid did say that he had brought a mechanic the last 2 times and paid him 300 dollars a trip. He wasn't available today, but the mechanic said "the engine was blowing oil out the intake" (whatever that means).
The judge was sympathetic. He said that it was a hard lesson to learn. But unless he could prove fraud via some expert witness, the judge needed to follow the law. Case dismissed.
What really grinds my gears is that the previous judge should have done the same thing. This cost all of us time and money. Especially this kid. He has 2 trips to Knox Co. Court and filing fee (85 bucks or so). Four trips to Nashville and filing fee (probaly 300 bucks in gas, and another 85 bucks) Paid the mechanic twice (600 bucks) Time off work etc.....I'm guessing around 1500 just out of pocket.
Actually if the kid had seeked council the first time, a half hour with an attorney, say 150 bucks or so. The attorney would have told him to drop it.
Oh well.
Again, thank for all the support, advice and humor. This thread will sink to the bottom of the forum, hopefully to pop up once in awhile to remind us all of what is out there, lurking.
