Don't give in to the guy or his mom.If you give them anything at all even towards helping on repairs your admitting some thing was wrong.(in the eyes of the courts anyway)Then he has a case against you. You sold AS Is. let it stand at that. Think I've watched to much Judge Judy:rolleyes!!

You obviously have not read the entire thread or at least the last page where everyone is congratulating CB for winning. The "giving them money" and it ramification was also covered in the thread. I know is a long thread, but if you want to comment on it you really have to read it...

I once met a guy who sold his homebuilt experimental airplane. In an effort to relinquish his liability, on his bill of sale he put a guarantee that the aircraft would fail and/or kill the occupants within the next 20 years or he would fully refund the purchase price. Don't know how it worked out for him.

CB, beautiful sailboat, congratulations and enjoy...

Re: sold a boat and it busted!

CB,
Your story gives me hope. I'm sure that nobody on this site will believe me but I am involved in a case that actually has yours topped in ridiculousness, seriousness and length of time that it has been going on for.

Well my court case came to an end today after over 5 years of going back and forth. My lawyers told me to keep my mouth shut (not to discuss the particulars of the case) but now it's over so here goes the super short version.

I was rear ended by a guy on a motorcycle who was doing well over 100 MPH. He hit me!!!
Needless to say he was pretty banged up and because he was at fault he wasn't going to get any compensation. So he has been suing me for the past 5 years. My lawyers (Allstate) settled today for $10,000. While this guy doesn't deserve a penny as his actions were solely responsible for the actions this is a case where the cost of litigation and risk of a partial judgment in his favor made the ten G's in Allstate's best interest (so says my lawyer). As this was well under my limits of coverage it won't cost me a penny.

It's strange to me that after years of litigation both CB's case as well as my own have come to an end within a week of each others.

I know that this is CB's thread. I wanted to share my story with him sooner but thaught that there was no upside to ignoring my lawyers advise about not discussing the case.

I'm very glad to see that common sense somehow prevailed after all you've been through. It's just too bad it's cost you the $800 or so bucks to find it.
There should be a law making the claimant responsible for all of your expenses which he wrongfully caused.

Although I'm sure your glad to be rid of this mess once and for all, I'd still be tempted to go after him for court costs and compensation for all your time and aggravation.

Wow! Incredible! Unfortunately 10K was probably a bargain.

I think there was a post early on where someone sold a motorcycle and was sued by the buyer for medical costs when the new owner got in an accident.

REELFISH is probably lucky the guy he gave his boat to isn't taking him to court too!

Re: sold a boat and it busted!

wow scipper that sucks. I once hit a lady (brake line blew on my car) and did $245 worth of damage to her Saturn. She somehow successfully sued my insurance company for the maximum limits of my coverage which at the time was $50,000. She didn't work for over a year. After the accident I called 911. Once they were told no one was hurt they were transferring me to the local police. Well this lady didn't want to wait around so she said forget it and had me hang up. I thought she had kinda waived her rights at that point but boy was I wrong! Fortunately it never really cost me anything out of pocket.

Re: sold a boat and it busted!

I guess I've been lucky so far, I've not heard a thing in a few weeks now from the idiot that took the boat. I drove by his house and neither the boat nor his car have been there either. I'm waiting for the boat to surface on a back road someplace. If it does, I'd gladly go get it, just to put an end to the whole mess once and for all. Next time it will leave in a trash can or with a price tag and a bill of sale.

The level which some people will stoop to in order to make a buck is utterly amazing. I don't think I'd ever have the type of problem with this guy that CB has had with his idiot, but there's not much stopping someone from trying it in our current legal system. A judge once told me that when it comes to small claims court, you can sue someone if you don't like the color of their car or house, it don't mean you'll win, but you can file suit. It's up to a judge to see the truth in a situation.

Unfortunately, not all of then see all too clearly sometimes. I suppose we're just lucky when they do.

Re: sold a boat and it busted!

My mom actually did ride out with me to look at it and pick it up. Needed someone to watch the rugrat while i was test driving. She thinks it's a nice car.

All in all I feel country was up front and open about everything he thought could be an issue with the car. I got an extremely good deal on this and really needed it too so I am thankful.

Re: sold a boat and it busted!-updated-round two!

Re: sold a boat and it busted!-updated-round two!

One boat I bought years didn't work out so good. I didn't want the boat (a 14' Glastron or something, painted with red house paint!) but it had a 1995 40hp on it. I wanted that. The seller was a nice guy, and we made our arrangements, and I went my way with the boat.

A year later, I finished the boat it was going to go on, and needed a few parts. Dumb me! it was a 1985, and on closer examination discovered the motor had recieved major surgery and was a put-together. I had paid more than double what the motor was worth and was stuck with a junk boat and a terrible trailer.

I am not easy to take advantage of but that day I was. Buyer beware, even if the seller is good intentioned. It is nice to buy from folks you know.
