What are the chances these (expletive deleted by HW) shmucks will call down on the 20th to ask for a continuance because that's the day junior gets to enroll at Rocco's Barber College. Not wishing to drag it out on CB but this thing has already gone way too long. GOOD LUCK to CB. Keep posting.:D

This is why I am really thinking of buying a ton of land and building a log cabin on it...and just live off the land. Society is really worrying me. Nobody is responsible anymore. Everybody is a victim.

I am even afraid now to leave stuff on curb with a free sign - God forbid that they get hurt using it!!!

This is beyond absurd. The only justice that can come from this is that the "BUYER" has to pay all the court fees and compensate for CB's time and mental anguish.

Shoot....we need to file a class action suit against him since I have been on such an emotional roller-coaster ride about this myself. It isn't my fault that I read this....I am the victim. :p

CB - if you need anything....ask..and I am sure someone here will be able to provide. We should get a "Fly Don S down to be CB's expert mechanic Fund" going.

I'm not sure, but I don't think a defendant can recoup his legal fees, unless it is found to be a frivolous lawsuit (which this is). I think if I were CB, I'd immediately file suit for court costs once this is found in his favor by a sane judge.

Great point, and if I lost, how would they collect their judgement?


Answer:I would pay because I would feel it was my civic duty to pay.

Wow, lawyers have sure screwed up this world. I really hope you win this one and they have reimburse you for your time and costs for this. Goes to show you that there is always an ambulance chaser waiting to pounce.

bond-o would be cheaper...(hes closer)..and after the lawers take all our money...(well worth it! )

we would have enough money to buy the i boaters all a beer !

come to think of it....let send them both down there....

(bondo-s close...so it wouldnt cost a lot)...but don is way across the nation....

but who cares???....lets send em....mabe we could finally get the two in a room and they could make a real mechanics service shop...:)

Ok I am a noob on this thread, I also have looked at all 20 something pages. You will have more luck at the state court level. Their judges are more intune with case law and understand the law better. The county courts I have found are a Mickey Mouse court where nobody wants to hurt feelings. Just my personal feelings you should come out ok, any district court judge will not allow a bill of sale like that create case law. That would mean that everybody who bought a vehicle without a warranty could come back on the previous owner for their misfortune. Continue to keep us posted, like I said I clicked through 20 pages of your posts about this.

This is interesting. I just got off the phone with the Knox Co. Fire Marshals Office. The particular addess that was on the first two warrants I recieved had a house fire on 4/12/2008. The Fire Marshal estimated the damage at $8,000.

The notice of appeal and new court date was sent out in January 2008.

The court date was early in June 2008.

he needs money........just one more cannon to fire at him.......real judges dont like to be lied to.....love to see his face when your attorney asks him when the fire was.

I see no reason why I can't share this too: I just talked to my attorney and he has a copy of the Fire Marshal's report in his hand.

I don't know about other states, but here in CA it's pretty easy. The courts provide LOTS of help.

Good luck with the judge. I cannot stretch my imagination far enough to see how you can lose. However, do NOT let this case go before a jury. That would be a crap shoot! BTDT

Yeah, I'm an addict.....ALWAYS looking for my next fix in this saga. How do we sign up for a CAS against MR. MY Boat Broke and My House Burned Down. <sob, cry, whine> This guy has made me afraid to sell anything....GEEZ, I am afraid to even put it out for garbage. $8,000 buys a heckuva nice double-wide with polyester curtains and a redwood deck in those parts from what I understand.:D:D:D


But seriously, I've been quietly lurking on this post for weeks, and I'm in utter disbelief of the courts rulings and decisions so far. You won't have any problems when dealing with the appeal. It will be a real judge, who will know the law.

If you could, I'd ask your atty about filing a counter-suit against him for a frivolous lawsuit. Not sure if you can, but it would hurt to ask, and he'd have to come to your county to fight it.
