wow, huge thread. glad to see you won in the end.

people who refuse to take responsibility for there own actions like those 2 make me sick. they deserve to be beaten with a stick until dead for always trying to screw over honest people for there own mistakes.

Saw on a different thread that this issue still hasn't died...I no longer have to watch any soap operas...I can get all the drama right here...

That email got my heart jumping. So I call and got his voicemail, but he just got back to me a second ago.


Here's the deal: The kid called the court and said that he never got notice of the appeal date because his house burnt down and he had to move. I don't know how this all works, but the court rescheduled this for Oct 20th.

Now I know you are all thinking the same thing as me. Your mail just doesn't dissappear.

The notice went out on Jan 18th and we sent him our 'evidence' (pics and stuff) 3 days before the actual court date which was back in June. Nothing got returned to us. Now unfortunatly I think this was sent via 1st class USPS an I don't think there was delivery confimation.

Anyway, my lawyer is going to find out when the house burned down. If it was after Jan 20th or so the kid just ruined his credibility.

The courts (around here anyway) are VERY reluctant to rule against someone who doesn't show up. I had a small claims case where the other party asked for an extension the day before because he had surgery scheduled. He knew BEFORE he scheduled the surgery and he scheduled it way before the day before the trial date. We showed up, he didn't and the judge granted the rescheduling above our objections.

See if a forwarding address is on file or if mail is being delivered to the previous location and still picked up. USPS won't deliver past a certain point.

Good luck - hoping for justice in the end!

His credibility was ruined a long time ago. My guess is that someone lost a job and they need CASH, which is why this finally took off.

Where the H*LL did he move to Mars. Sounds like BS to me. I know it's a PITA Country, but keep up the Good fight. This jerk deserves it and this is starting to sound like harassment.:(

I was thinking the exact same thing. Wow...These are quite the characters you've had to deal with CB.

How many twists and turns has this thing taken? LOL!

How do you go almost a year from the actual court date, 4 months from the appeal date, and then wake up one day and think "Hey! CB never paid me for the boat! and wasn't there supposed to be an appeal????"
