All I can say is wow. Good luck with all of this.

If the damn thing ran flawlessly for 3 hours straight and didn't smoke or make any ticking or knocking noises then there was nothing wrong with it. For the most part, engines don't just die. Something catastrophic (no oil, over rev, over heat, H20 ingestion, etc) usually has to happen to make the engine just give up.

EDIT: I am from Middle TN. I lived in Cheatham Co for 10 yrs and went to MTSU in Murfreesboro for 5 yrs.

Took me over 2 hours to read all the way to page 21. I hate reading novels where the last chapter hasn't been wrote yet. But you got me hooked.

Agreed - a tired engine will run a long time with bad bearings or rings, but if either finally lets go it makes noise. Shutting it off can save the engine block. However, there are symptoms of both of these that a thorough inspection will identify, such as oil pressure, oil analysis, and cylinder leakdown tests.

I still wonder what he did, because an overheating engine won't throw oil everywhere. The engines I've overheated started knocking and eventually just died. After cooling down, they started right up.

Hi everyone! Thanks for the interest.

For some of the newer readers, this is my take.

The tachometer DID NOT WORK! All other guages did. I clearly stated this in the add, and pointed it out on the test drive. That means he could have over-reved it for extended periods. BUT all other guages did work! If he glanced down at the oil pressure and saw it too low, or the temp guage and saw it to high, the engine should have been shut down to prevent serious damage.

My thought:
1) New boat to the kid.
2) Ran great
3) Full speed ahead all day
4) "Something" happened and it wasn't noticed. (impellar? gasket?)
5) STILL FULL SPEED AHEAD!
6) Knock Knock, BOOM BOOM

What screwed me was making the comment that the engine was in excellent condition. What upsets me is that we (my lawyer and I) never pointed out to the judge that is was common knowledge that the TACH DIDN'T WORK!

I think he did notice it and kept going anyway.

Although it was quite some time ago, try and find a copy of the ad. that says the Tach didn't work. Most publications have great archival records. I'm sure it would help your case.
Maybe we (the iboats group) could come up with a short idiot-proof disclaimer we can all use when we sell a boat to avoid this situation from happening again.

You got screwed when you got an idiot for a judge:
Does the engine failure prove that it wasn't in "excellent condition"?
The plaintiff's own expert witness testified that he didn't know why the engine failed and that it could have happened to a brand new engine.

At that point, the tach is moot.

Bump.

I've been following this for a while. I had a similar problem when i sold an old truck. The guy made plenty of threats, including showing up at my house, but never tried to sue.

Looking forward to hear what happens today.

Yup

BTW, a "yup" can sometimes be considered a Bump, but it is cheaper as it only has three letters, and could also be an actual answer to a previous post. In that case it would not be an actual Bump, so again, slightly less costly ;)

Well a "Bump" is less costly than say a "line" or a "rail" for that matter. Id be happy with a bump but would prefer a line and a rail would be better yet. I have to work tonight so i most likely wont see CB's post till late tonight i hope he lets us know what happens! Ill be thinking about it whyle im at work. If i had internet there id be checking every hour or so to see what happened.

depends if they had a morning session or afternoon, if after noon he may not be out yet.
he usually posted by 2 30 pm my time 530 east coast.

i think this stage is just a fomality.
