Hey CB it was me that asked to see the pics on the show ya boat thread. Thanks for sharing. Thats a nice boat i dont see what they are crying about they should sell it like it is and get most of their money back! instead of spending all that money giving you a hard time. But who's to say that they arent going to sell the boat and get their money back, then sue you and get double their money back. I know you will prob win but just sounds like the kinda scam that low lives like that try to pull! Good luck!

I agree with the rest here--first off--it's sold "AS IS"--you have NO responsibity to this guy---I WOULD NOTgive him a dime--it ran good when he picked it up and it's a old boat---too bad--so sad--Steve

Yeah, I forgot about that. The floor hand a soft spot in the cuddy where water accumulated over the years. I cut those deck boards to fit the tapered shape of the kneewell and secured the to a frame. It worked great and looked pretty too.



Since I'm out here I might as well tell ya'll I talked to my attorney today. Next round is scheduled next week. Wed. October 24.

Would it be worth the expense to hire a private investigator to check out the story on how the engine got fried?

You know: go to where they say it was launched from, ask if anyone saw them. Ask some neighbors if they heard it running in the back yard, etc. If they were out on a lake, they would most likely needed a tow back to shore... Whoever that was would be a good person to talk to.

At worst case you will have a bit more info. At best case, they will have lied about something and you will have a witness to call them on it.

Naw, that's what "discovery" is all about. CB won't say, but there has to be a reason for continuance.

Make the whiner do the work.

Think about it. Now that the proceedings are on home turf, the plaintiffs have to travel 100s of miles each time they want to pursue it. It takes a few minutes to request a continuance and there are many "good" reasons one can conjure up for requesting a continuance. It doesn't take long to wear people down to the point it's no longer worth the effort. Especially when they have to pay "expert" witnesses to show up each time not knowing if the show will go on. The one day they show up without them, BINGO!, we're ready to go. You're not? Too bad, so sad. That's one way to handle it.

More than likely, they will give up this charade because they know they don't have a leg to stand on. These people count on the other side caving and they finally met someone who is willing to stand up to them. Either that, or they're dumb as a box of rocks and just don't know any better. Either way, they're in for an education...

The words "Sold As Is" is their for a reason. Since you were there he might have pushed the boat to much and could have been doing thing he shouldn't have and burned it up. It like anything, you never know when something could break down. That is the thing about buying used. Whenever you buy anything used you always run that risk, that is something he should have thought about before buying it. Everyone wants to buy a perfect boat at a great price, but we all know that in a week, month, or year it could break down.

I'm no laywer, but isn't discovery is usually performed by the litigating parties - not by the courts? If so, then its kinda up to Country_Bumpkin to find out what the other side dosn't want him to find. They certainly know what *NOT* to look for, and wouldn't submit it as evidence.

It could be a matter of more than just winning the case: if someone knowingly made untruthful statements, then it's perjury. :mad:

Seems like they would have already done that by now - they have seen that CB has a lawyer that knows what he's doing, and plays hardball. In a way, he has tipped his hand somewhat.
To review: CB didn't cave when they confronted him themselves. He didn't cave when they went to court.
He's moved the venue to 'nullify' the inconvienience to him of going to their turf. He has a lawyer that obviously knows how to play hardball.


The fact that they haven't pulled out of this yet means that they feel that they have *some* sort of means of winning.

Or they are just really stubborn. There's no telling with people.

As far as I know, they don't have a lawyer............none showed up last week, and none was listed on the warrant. My attorney suggested that they at least talk to one.

This will be interesting. There is a possiblity that they will not show up again if they talked to a lawyer, but a perfect opportunity to run up my legal fees if they don't tell us. I have to go regardless.

It's going to be a great weekend here in middle Tennessee for some fall boating! Get it while you still can!

I actually went and bought all my winterizing stuff yesterday -- but you are right. Perhaps I should hit Priest one more time -- as long as they have not started lowering it.

just because you are asking on this post means your concince is hurt. as would anyones be. only you know if the boat was good.
however. as an owner of a retail store i have heard all kinds of stories. I must agree you dont know all the facts of what happened that day.
and i must agree totally with every one else.

further more if you offer to pay ANYTHING you are admitting guilt!

Dont pay a cent or they (mom and him) have a case .

any person knows to listen to the motor when it starts to knock and take precautions. He did not. it is very unlikely that the conn rod just broke.
my guess is he wanted to see what it could do, had a few beers and thought the knocking was ac/dc on the stereo!
you know in your heart if there was any thing wrong with the boat.
if yes, and you dont fix it, then your are ripping him off.
if no. then you may have a few sleepless nights but just remember that in your heart you knew the motor was good, and try to forget about it.

The other side brought an "expert" witness, with some information. In a civil suit, you are entitled to that evidence in writing in advance, so you can reasonably respond to it. The witness is not there to deliver the evidence, but to respond to questioning about it.

The response to surprise is to request a continuance to allow discovery. It's a fool that pulls the surprise card long distance.

Let's watch this cool lawyer take care of this with little effort or expense.

I'd be willing to bet, because I have teenage boys myself, that the lad showed off the rig in the driveway by starting it up and rapping it a few times for each friend that came by. Then when he put it on the lake and the water pump failed, he didn't notice the smell, noise, or gauges. Actually, my boys know better, but I had one with a strong head that did just that to a very nice running car, ruining it for good. He just didn't have the time or ambition to worry about anti-freeze, or check the oil, and he drove it like he was mad at it.

I think I'm gonna get one more day on the water tomorrow. My daughter was going to move tomorrow, and suddenly changed that to Sunday. Tomorrow will be worth boating and fishing, Sunday promises to be rainy again. I'd rather play in the sun and move in the rain.
