Re: "My" run in with the law.

Good statement Bubba. I too do not like the bad guy syndrome nor do I compare them with the brown shirted Nazi's. Every occupation has it's thugs! When I was in Catholic school in the early 60's I thought the Nun's were thugs with their wooden ruler's and the physical punishment they used to deal out.......... not all the Nun's were thugs!

As a personal request and a request to all the iboats member's ........ I am not fond of using the Nazi term. It is unprofessional and we are all above that. I have many friends and family who are Jewish and that word is not used for any other purpose. If people want to use thugs or any other socially accepted descriptive word I am okay with that.

I guess it is sad but Bubba you are not alone. I imagine that type incident happens more then people (the public) are aware of. The ONLY time we hear about it is when that thug tactic is successful in capturing a real criminal.

I have one more thing to say about this topic.......You guys, all of you, are holding me up.....I've been here a couple hours now and you must let me go. It is a rainy day and perfect for the honey-do-list.

Bubba, I truely enjoy your posts and if I were you I would spend my spare time pursuing this matter to your satisfaction and get off the computer .......least that's what I keep telling myself. :)

LOL at Ezombee.

Well, I know this isn't a popular place to say this but WTH.

Why be so defiant against a search if you have nothing to hide. I'm one of the first people to stand up for my rights but I also know if I didn't have anything to hide, I would have let them check my vehicle.

Truth is, we don't always have ALL the information. They were evidently looking for someone or something in particular. In order to move the process along peacefully, wouldn't have been easier to just let them check? Write a letter to the editor or Chief of Police afterward? Why refuse and **** them off.

I think there are times and places to 'make your point' about civil rights. I'm not sure that you chose a good one.

Just sayin.

I find this very interesting as I am a law enforcement officer here in Canada....but I always say there are 2 sides to every story and I would like to hear the other side.
I do have a question though....why do you carry a handgun in your vehicle? Is it that dangerous where you live? or is it simply because you can ?

Re: "My" run in with the law.

fisherguy,

As a licensed person that has the credentials as well as the desire, I always carry my personal weapon, and it has come in handy in the past, I don't normally carry my training weapons any longer because I have pretty much retired from doing on the ground training. My wife also carries, she is a firearms instructor as well, she specializes in teaching female classes to those who wish to carry and her curriculum has become quite popular as well as effective with females. She has had two situations in her life that she has actually had to use her carry weapon. Where we live, we are a long ways away from law enforcement so have to depend on ourselves if the need arises, it takes over 50 minutes to get to my location from the local law enforcement station.

I guess when it comes down to it, I simple feel safer when I am carrying, and I know there are those that say it can escalate a situation, but I have not found that to be true..in my particular life experience.

I don't know LF, I'm about as much a pinko commie as you can get :p and even I have a real problem with this. It's a slippery slope and I don't think it is an exaggeration to take up the "yeah but then what's next" position. I would not consent to this search either. I'm also not a gun guy at ALL and yet I'm very concerned about all the stink that was caused by Bubba's fully legal carry permit. I think I would make a fuss also.

Yes in rare cases such as a terrorist threat I can the see the validity in these checks......but I think We would be better served if they were actively patrolling the community rather than standing in the highway. You don't have to sniff the whole yard to find the dogpile.

Why would you give up any of your rights? What if they wanted you to give up your right to free speech or your right to freedom of religion?

Re: "My" run in with the law.

I am in no way against law enforcement, but I spent 26 years in the Military defending those freedoms that we all enjoy and I know far to many who have died for them, if there is no probable cause issues for search, then there is no reason for them to search your vehicle on a fishing expedition..

There is all often the excused used "If you have nothing to hide, then why not say yes" Well you simply don't have to say yes. I am not a hard nose, but I won't allow myself to be subjected to what I consider a violation of my rights...probable cause is one of the most abused powers in this country..but if it does not fit the situation and you have given them no reason, there is no search without a warrant.

Don't get C R A Z Y on me. I come from the "burn your bra" era. I participating in many 'sit in's' and protests of all sorts but this is about common sense.

I will fight for my civil rights right along side the rest of you. However, we also have the right to be protected. When the law deems it necessary for us to cooperate with them while working on an investigation, then I will do my part.

I have many friends that are DEA, VICE, TABC and FBI, there is so much going on that John Q public is not aware of. An innocent motorist is never going to know the reason for vehicle checks if they are stopping every car at a check point. As I said before there is a time and place to protest. Unless I had something to hide, I would cooperate. I think there is more to the story on both ends.

Terrorists come in all sizes, shapes, and colors. We have plenty of home grown ones too. If all I had to do is allow an officer of the law to check my vehicle to aid in their search for one, sobeit. I'm happy to help out.

I totally believe that in this particular instance, the law may have been looking for someone. Not sure it would have been considered 'abuse of power' to search anyone's vehicle.

All I am saying is, why interfere with what they are doing. Let them know that they do not have your consent. You can always challenge the legitimacy of the search later in court.

Re: "My" run in with the law.

There is a feeling in the country, due to airline search rules, that they terrorists have already won, due to the fact, we actually give up much of our right to undue search and seizure when we find ourselves with the need to fly. I will be darned if I am going to give those same rights and let the criminal win...and really I am not trying to be political, but my car, as my home is my personal space and without a probable cause or a warrant, I am not going to let them search it..I will take the ride downtown each and every single time..

I paid the price to have those rights and I intend to keep them.. two Purple Hearts, One Silver Star and years of my life as well as my buddies paid for it, I do not intend to dishonor that..

As I have said, I am not against Law Enforcement. 99% of LEO are great people, but there is again that 1% factor...if they were in fact working on an investigation, it should have been clearly stated that was what the intent was...to use the guise of a "safety check" Which all of us would agree is a good thing, to many unsafe cars on the road, was and has always been in my opinion a weak excuse..I went through check points in the Middle east and felt they were needed, but in this manner, I don't agree. Once the vehicle is checked and found to be safe there is no reason to go further..

Anyway, I am going to go and enjoy the rest of the afternoon..

Re: "My" run in with the law.

First, let me thank you for your service and for protecting me and my family MTboatguy. I understand your passion about this incident.

Nuff said. I'll drop my point of view for now. I certainly don't want to incite an argument about this. Just voicing my opinion which I have the right to do.

Thanks for starting this very interesting and thought provoking thread.

Ladyfish: you don't get it - he didn't have something to hide, he had something to openly display - his rights. It is illegal to set up a road block for the purpose of searching vehicals. The safety check is just subterfuge. They just happen to have a drug dog on hand - what a coincidence. The police are intimidating - they do not have the right to stop you without cause, and detain you. When you aquiesse to those tactics you help erode are freedom.
Fisherguy: Bubba has a right to carry his gun - thats all you need to know.

R Socey, I get it, I totally get it.

(Shaking head here) :rolleyes:You guys really don't know me very well because if you did you would realize that I was simply looking at the situation from another perspective. I'm all about protecting our civil rights. I was stating that personally, I would not have baulked at that very moment in time about a search is all. Time and place sort of thing.

Sheesh, why don't all y'all go ice fishing.;)

They are looking to arrest YOU! and it cost you lots and lots of money to prove you had done nothing wrong.

Re: "My" run in with the law.

Got any contraband or weapons on board? Bad guy says nope and drives down the road. Good guy says yep and sits by the side of the road? The police never do get to admire the Colt?
I've never encountered such a road block, here they make you stop, and ask if you have any fruit :D
