It is obvious to me that we need to recreate this incident. Out of the goodness of my heart I volunteer to play the part of the boater on the right. Who wants to play the meat in the middle? The squirrely slice of bread on the left?

welp... the lawyer just called me

remember in the begingin i said i went to trial and they declared a mis-trial.. well , see what happend was they coded the citation wrong. so my trial was in the wrong court room.. and trial had started, the judge then became aware of the error and then delcared a mis-trial.. but since ther was a witness on the stand "jepordy" is in place... and they can not try me again for the same offense... the case is going to be dismissed on the 11th for the mis trial do to double jepordy.. god i love the united states....

Now on 2 the personal injury suit and getting my jet ski back, along with the 90,000+ in medical bills...

justice, hardly.

you can't hear a boat barreling down on you from 15' away but you can hear your buddies goofing off on the shore?

that pic reinforces that you can't see behind you with spray like that and you're halfway standing up. no way you can keep proper control of the vessel and lookout while turning around to look behind

i hope to never cross paths with you on the water. good luck with your leg.

I would still look into having a citation served against him. If he gets found guilty it's a slam dunk for you in civil
court.

in regards to the control.. i can handle it better standing up in choppy water cuz i can flow with the jet ski... now be bounced around, i can bend my knees. not as stiff....

Glad it worked out for you. You can ride your PWC around me anytime. I can do 55 easy on flat water, but I don't run anybody down when I do. Make sure you tell all your friends about the great hospitality and welcome you received here at iboats :/ ...

I am curious about the boater who pulled you from the
water. What did he say.........I beleive he saw it all
I am sure with you 30 feet abeam he was watching closely.

To me your distances and actions don't add up.
15 feet from you yet you tried to turn right and see him headed right? Yeah Right!!!

You admit you saw him behind you then are surprised
you turn into his path?

I wasn't there and don't know the area but you took
your eye off the ball.

Something to think about... I am a boat guy, my neighbor has a PWC. Sometimes we take both out for a days outing and I spend some time on the PWC. The very first time I got on his ski, my immediate thought and later insistence, was that the ski NEEDED mirrors. That afternoon we went and got a set of mirrors for the PWC, makes a world of difference. His is a pretty big ski, yet it turns sharply, you need to see in a pretty good radius around you before you make such a sharp turn. Right or wrong, a big boat just can't veer off as sharply or quickly as a little PWC; for safety sake, you want to see what's coming up behind before you cut in front of it.

u didnt read it right then.....
I was going straight, there was a boat on my right.... there was another guy BEHIND us flying up, neather of us knew he was there...... i turned left just as he flew up and tried to pass...... the boater on the right is the guy that got me out of the water. and he is one of the witnesses that were in court on my behalf....

and to the mirror comment, one ski does have mirrors, the GTI LE, but i was riding my GTI.. its just a standard jet ski, no addons, has a fuel guage and an added on speed-o-meter :)

Doesnt matter anymore really.. the case is going to be dismissed becuz of a technicallity, my other lawyer who is handling the injury suit is already in process now of getting everything set up to go after the boater and the insurance company... a dismiss is as good as a win when it comes 2 these things...
oh ims ure the boater is pissed the courts messed up.. but................... oh well....
thanks all for ure advice, ill be stickin around here for a bit, seems like a great community.

i jsut talked to my lawyer and well he said its not going to matter whos fault it was in this case

I'm sorry,,,,,,But I think people should take responsibility for their own actions. We don't always need a lawyer and judge to determine who was at fault, especially here, you BOTH WERE. Soooo,,,,,,why try to make him more responsible for the (obvious) accident, than you were, except for monetary gain ? Oh, wait a
minute,,,,Pleeeese don't tell me this is "one of those free lawyers" unless you win the case.

I've heard one side of the story and there is always two sides. If I take what you said, as to what happened, as fact, I would come to the conclusion that both of you are irresponsible boat operators. One no more or less than the other. You both broke the rules of the road. Careless operation of water craft. As far as I'm concerned you should both take the bump on your heads (no pun intended) and go your own ways. You both learned an unfortunate lesson here. I'm sure he'll slow down some and you'll learn how to do that Linda Blair thing with your head. I'm just glad no one was killed this time.

Just a side note, It makes no difference to me what type of watercraft you were driving.

BTW doesn't that Seadoo have rearview mirrors ? He was 40 ft behind you, and 15 ft to the side,,,,Your mirrors should have been full of boat and white water.

the GTI LE does, i have that ski, but i also have the GTI... which doesnt have em.
and it isnt normaly a pay if u win lawyer, but thats how he is going to do it, he a family members buisness partner..
im not looking for a pitty party here, but i had just started a new job, working at a body shop painting cars, my health insurance had not yet become active, i have over 90,000 in medical bills that need to be paid..... and no, sadly, i know, i wasnt insured yet on that craft, it was recently purchased from my friend. a week or so prior and like i said i had just started a new job, and didnt have the money to add that yet on the craft.. i know i shouldnt have been riding it then right? but... i did.. and well.. i dont have 90,000 and i need my medical bills payed..

You couldn't afford insurance on your jet ski because of cases like this. I hate to say this because I feel for your health and physical welfare, but "this law suit" is exploiting money from the other guy because you chose to boat without any kind of insurance, I really hope you and your lawyer loose this case in court as it has no legitiment reason being there. Dude,,,,You gambled when you got on that jet ski, and lost, suck it up.

His speed, 55 mph, 82.5 feet per second

His speed and proximity would be a factor if I was hearing the case.
But if this judge will even hear it, is another story.
