And for the record, in my state, if an intruder is in your home, you may use lethal force, no questions asked. There is an automatic assumption of a threat to life if someone has made it into your dwelling.

This rule does not, however, apply to non-attached garages, sheds, etc.

Re: thieves took wifes pocketbook

Congratulations to gary in Matthews . Im a native of charlotte and think the same way he does. No I would never plan to shoot anyone breaking into my shop or car but I do think I have the right to confront them at gunpoint and demand they put their hands up and wait till the cops arrive. If they want to attack me and not wait then I feel I can protect myself and blow their arse away...Anyone have a problem with this?

Sounds straight up to me! You ever need backup let me know...:D

I don't get to shoot very often...lol!

Oh, one of the smartest things I have heard recently is if you have an automatic trunk opener in the glove box or were ever, pull the fuse and use your key.

Winging em's a good idea though.:)

Not in Colo. If you have to use your firearm, it better be with the intent to kill. If you tell the LEO you were just trying to slow him down, etc, you're going to jail for mis-use of a deadly weapon. Any firearm is designed to kill, not wound. (all according to our handgun instructor).
When I took the handgun course for my concealed permit we were trained to use 2 shots to the chest, then back to a ready mode, 2 more shots to the chest if they're still a threat (not likely if I put 2 185 grain Winchester SXT 45's into their chest!).

Hopefully you can find the dirtbags!!

The bolded part will get you put in prison for murder, or if you're a ****ty shot, attempted murder.

No matter how much you despise a thief, you CANNOT SHOOT TO DEFEND PROPERTY. No matter what state you are in, this is NOT NEGOTIABLE AND YOU WILL GO TO PRISON FOR THE REST OF YOUR LIFE IF YOU DO.

In Louisiana, and a few other states, they are "right to confront" states. Meaning.....and carefully read this, you may "confront" someone on your property with a gun. And you do NOT have to back down. If they are willing to charge at you, or reach and possibly pull a gun of their own out even staring down the barrel of yours, then you can, and ONLY THEN, have the right to shoot to stop the threat. Notice I didn't say "shoot to kill." If you shoot them in the back, for instance, you'll go to prison. No one is a threat to you running away. I had a concealed handgun permit and took and passed the required course without problems. I learned a lot. CC permits are about when NOT to use a gun, not when TO use one. Basically, if there is ANY doubt whether your life is in danger, it's probably not and it's your adrenaline pumping. Keep the gun squarely on his chest, give him a chance to leave, and call the police. Let them do their job. Yours is only to survive.

Not long ago someone broke into my truck and stole, of all things, my radar detector. I was prepared, and still am, to confront him with lethal force, but ONLY if he comes after me and you MUST give him an "out." You can't corner him in a fenced yard and then tell him if he comes at you he's dead. You're giving him no choice. He must be given a way out. He does NOT have to stay when you say you will hold him at gunpoint until the cops arrive. If you shoot him when he is trying to get away, you will spend the rest of your adult life in prison.

You MUST be careful with this. If you want to go to prison for life because someone is stealing a purse, that is your personal choice, but I believe it would be one you would regret the day they slapped the handcuffs on you. You can always buy another purse, you can't take back a poor choice like lethal force.

A lot of 'correct' answers to a 'probable situation'... it comes down to knowing the law and your rights in your state.

In Raleigh NC a home had 3 guys break in, the home owner shot one in the chest the other two were shot in the back....NO CHARGES were filed against him.
Not long ago, someone was kicking in the door of an elderly woman (around 80) she shot her shot gun through the door hitting the perpetrator with buckshot...NO CHARGES were filed.

Re: thieves took wifes pocketbook

Ok pretty simple deal here, any person has the right to use a gun to effect a citizens arrest, the authorities could challenge it in some anti gun states however they would lose badly when it goes to this SCOTUS(your going to pay dearly financially though).

Also shooting a person who is unlawfully inside your home here in Colorado you are within your rights to use deadly force to eliminate the threat, this has been tested to the Colorado Supreme Court. You are not within your rights to use deadly force to protect property unless you feel you are in fear for your well being, although this has yet to be tested to the Colorado Supreme Court. Each of these laws do not in anyway hold true in other states but I feel confident that they do in Arizona and Texas.

Anyone that shoots to wound is asking for trouble, when you go to court your going to be asked why you shot him in the leg? why not shoot him in the foot? the hand? Soon your credibility is in question. Shoot center of mass until the threat ends, if that means you had to load another magazine so be it. When your asked in court why you shot the man inside your house 5 times your answer should be I shot until the threat ended. This is a common explanation given by police officers and can be used by civilians as well.

It is common for those involved in home defense that after shooting an intruder, the shooter lost count of the number of rounds actually shot so it has become a good practice to teach home defenders to automatically load a fresh magazine into the weapon this way you know exactly how many rounds you have left which is vastly more important then how many you have shot.

Think about this, if your involved in a home shooting, the police are going to take the weapon involved in that shooting...........do you have a spare?

When I am asked why I carry a gun I say because cops weigh to much!

I am going to research this because this is a contradiction to a persons right to citizens arrest, the way I see it the police have the right to shoot if they are in fear or to avoid flight as tested to the SCOTUS and therefore this should also be extended to civilians as well. You don't see Officers giving a person they intend to arrest at gunpoint an out EVER.

Not true. Michigan passed a self defense act a year or two ago. I will try to find the exact law and post. The castle doctrine now applies here. Before the new law you had to retreat until you could retreat no more before you could use lethal force. Not so now. If someone breaks into your home, car, boat etc you can assume they are there to do you bodily harm and react accordingly.

I hope no one ever breaks into my home but I would defend and use lethal force if needed.

I hope it is never needed but statisticly speaking there is on average 1 home invasion a week in my little city. I want to be prepared.

Re: thieves took wifes pocketbook

Not exactly, until a persons rights have been tested to the SCOTUS its nothing more then ink on paper. Initially I agreed with you that our new "make my day law" included a persons right to protect property but just a few months ago it was tested and the person plead to a lower charge. Now this person didn't have a huge bankroll in fact he was pretty poor but a better case for the NRA and or GOA to go after you couldn't find.......but they never did. This makes me feel that even the NRA and the GOA feel that Castle does not have the teeth alot of us thought it did. Don't get me wrong I hope Castle is what we hope it is but until it is tested fully were in limbo unless we have the money to test it ourselves. If your wondering this is a link to the story
http://blogs.westword.com/latestword/2010/07/robert_wallace_shooting_make_m.php

Sad story but in the end this man was free to go with probation for the rest of his life(HE IS 81 FREAKING YRS OLD). The Illegal immigrants: one voluntarily deported the other is still under the care of a taxpayer approved doctor here in the state. It would be a good idea for those who arm themselves to become savy in the laws and rights we as gun owners have, Just because its on paper doesn't mean its set in stone. Only laws tested to the SCOTUS are stone, it sucks but thats the way it is, thats why I promote those who are gun owners to join the NRA or GOA or both(like me) by ourselves we don't have the money to stand for our rights but together we do, by joining a large organization like the NRA or GOA we become more then brothers in arms we become brothers in rights also.

I prefer the GOA by the way.....NO COMPROMISE

The pocketbook was a gift.My son and I got it for her for xmas. They also took her key flob. Now I fear them coming back and going into her car anytime they want. I have a motion detector on the car now and figure if they plan to use the flob they wont wait long. Until then Im ready for whatever happens. I have 2 shotguns loaded near the door and the silent alarm beside my bed. This isnt the first time thieves have stolen from me and got away with it and even though I wouldnt shoot them for trying to steal I WILL if they threaten me ....this is a garantee

Sir I believe you are doing the right thing here, being stolen from is not something any of us should have to get used to.

Good luck

I agree with fishbone. I know of people who shot and killed burglars and no charges were filed. It is your word against his and if you kill him then there is only one side to the story. Unless the family of the slum-bag files charges there is not too much to worry about. In my neck of the woods there is not a whole lot of sympathy for thieves and crack heads. My neighbor also shot through her door, the guy was never caught but he left a trail of blood out to the road. A friend of mine awoke to a noise in his living room and when he went to investigate there were 2 guys robbing the place...one of the robbers shot my friend with a 16 ga shotgun and just about blew his hand off. My friend was able to run to his bedroom and grab an AK-47 and kill one guy...the other guy ran out of the house and my friend shot him as he was running across the front lawn...NO CHARGES WERE FILED.

Re: thieves took wifes pocketbook

Thanks for the advice. After 6 break ins all of which where when I was at home I know security system signs and motion lights do very little to stop the desperate thieves, And the police reports and little cards the cops give you with their name on it etc etc have never protected me for a second and if I catch a thief in the act I DONT PLAN TO ALLOW HIM TO LEAVE ,,His decision on what happens I guess. It was funny when my wife said "well they could have stolen your boat"....If that would have happened this post wouldn't be here because I would be in state of mind where I wouldn't be able to type.
