C.B. personally i would of paid anything regardless just to make sure that woman and her foolish child didnt get a dime ,but that,s me im stubborn all the way when it comes to that.

We picked up on that right away CB.

Shame though, you sell a boat to a no-mind, probably one you put some time, effort and money into just have it ruined. That happened to me with a truck once. Guy wrote it off first week he had it. Such a waste.

justice prevails! for now...........might I suggest keeping a close eye on your credit reports for the next few months - in case somebody gets an idea for revenge.................

My attorney said you can't do this, or at least that's what I understood him to say. Anyway his bill was 500 bucks. Right at what I was considering to give the kid at the very begining of this whole ordeal, until they started threatening this suit.

Cost me the same either way. They're out the 500 now.
What really bothers me is that an inocent man had to pay $500.00 to prove he is inocent. That is really messed up. Still better than the alternative have you losted the case.

I met an old Indian once that told me when he sold someone a car he gave it his "two tail light garantee" The buyer would leave and as long as he could see the 2 tail lights he garanteed the car to run........Same applys to boats...Once I sold a car and asked the guy if he had read my garantee. He said "no" I said "thats because there "AINT ONE "

About two years I bought a car from my grandpa. It was a real mint - ten year old Town Car with 59,000 miles on it.

Within three months the intake manifold split in half and the air bags in back started leaking. Know what I did? I very quietly took it to the dealer and had it fixed. Between the two it cost me a grand, but he never even found out. I'm sure he would ahve insisted on paying fo it and there's no way I was going to let him.

The air bags were ten years old and had cracks - big surprise. The intake manifold was a design flaw there was a recall on, but the recall did not cover my model (that sucks - it was too old).

The moral of the story is - buyer beware. Just like you - my grandfather had no idea these things were going to happen. He even waxed the car for me before selling it to me - I found some paste in the gap between the doors that was still wet when I picked it up!

Got a call into them right now.

I was really hoping this was over. Got the kids back to college, some other 'life' issues resolved. Was looking forward to a relaxing fall of overnighting and sailing on the lake.

Just talked to the deputy they, (actually he) filed it in Davidson Co. (Nashville), set for Oct 9th. No attorney representing him. I will call my dude tommorrow and see if he will help out, although I think if they cards were on the table I'd win hands down,

Let the soap opera resume!

Don't worry CB. It's BS of the 'nth degree. They haven't got a leg to stand on! Just a royal PITA for you though.

Keep it straight and keep it true and the Judge will toss 'em out on their azz's.

Hang in there CB, the Judge knows what 'as is' means. Let the jerk spin his wheels and chew up his time and money. You don't need an attorney from here on out.

The bummer about this thing is that he can keep pinging you. Which, even though you know you are right, causes you to have the emotional burden of dealing with this.

I had an altercation with my neighbor 2 years ago regarding the trimming of some trees. I tried to settle the matter with her and she essentially never responded to my communications. Almost two years to the day I get a notice that I am being sued for $7500.

Keep in mind I had sent her VM's and registered letters to engage her in a dialogue to settle this matter that went unanswered and the letters unaccepted.

The short part is that I won in small claims court because I was prepared and presented my side of the case. She did not present well at all. So in my mind its over. She had her day and lost.

Well nooo. A week later I get a notice that she has filed in district court to appeal the ruling. There is no ruling to determine if it is to be heard or not. Essentially the small claims is set aside for anyone willing to appeal.

When the judge requried us to go into the hallway in small claims to try to settle, the first thing she said was,"why didn't you call the insurance company?" I think she just assumed that there would be a settlement here. I said I did not need to that what she was asking for was out of bounds.

I finally did call the insurance company who would've represented me and covered the judgment. But we never got that far. I was suppposed to be in court this last Monday but she was using a fool for a lawyer and didn't follow the proper court procedure. The judge ruled for the plaintiff with no damages and cited the procedural errors.

The bad part is that this woman pretty much ruined two of my summers with this thing hanging over my head.

I feel for you but beleive your case is much stronger than mine and you will prevail. It just sucks that you have to waste your time on it.

Some more info, here is what he is claiming:

The summons said that I claimed the boat was in good, and excellent condition, (which it was when he took possession of it), and that he drove the boat for 4.5-5 hours the next day and then the engine stopped.

(Must have been running fine for the first 4 hours, just like it did on his test run.)

I just sent the warrant to my attorney, this thing is happening quick.

DUH! If he drove it for 4? to 5 hours, proof it was in excellent condition!
