cb good luck i have been reading this and hope everything goes well with u but to make you hopefully feel better. my brother just bought a boat off of a dealer it is used but they gave him a 30 day warranty. first run the day he picked it up put it in the water and no throttle took it back they ordered shift linkage when it came in a week later he tried again. this time it wouldn't start he took it back again they started it with starting fluid told him to carry a can with him then i adviced strongly against that. now he is about to run out of his temp registration to find out when they took the boat on trade they never had the title signed by the previous owner . been 3 months now boat has been in the dealer 6 times in the 1st month and now it runs and the end of the week he won't be able to use it untill the title is straightened aound.

And I don't even know the results yet, but will shortly.

Since it has already happened I think I can tell you what strategy was taken.

My attorney filed a motion to dismiss the case on the grounds that Knox Co. didnt have juristdiction on the matter. If we were to actually fight the suit he wanted it here, in familiar territory. The judge agreed to consider the motion without any of us going there.

I sent an affidavit with some simple, true statements:

Where I live
Where the boat was advertised
Where the boat was test driven
Where the money and bill of sale were exchanged
That his Mom was not present
etc.

If they (the buyers) agreed that these statments were true, then my attorney felt very confident that the judge would dismiss the case and tell them if they wanted to pursue the matter it would have to be in Nasvhille.

As of last night the computers were not updated with the days results yet, so I am as anxious as ya'll are to find out what happened.

Wish I could have been a fly on the wall watching them scope out the courtroom, not seeing me there and thinking that they would win by default.

well cb hopefully they will drop it instead of them wasting the time to come there and waste the gas and time. hoping for the best for you so you can enjoy the sailing.

Was it dismissed because of jurisdiction? Can they refile it in your county?

AWESOME!!!! I wonder if they will actually travel to your county to file again? It wouldn't surprise e if they did. I bet they were thinking that you weren't showing yesterday. I am so happy for you!

was it dismissed with or without prejudice? With means they can never file again. Without means they can file again. I am assuming it was due to lack of jurisdiction. If so they can file in your county, but it will cost them a bit more to do it. The good thing is they don't get their filing fee back from the wrong county.

Dismissed due to jurisdiction. THEY can travel the 360 mile round trip to file it here in Nashville if they want.

But, my lawyer would be on his turf. I have no doubt that we would win.
