Public Safety has been mandated by the FCC to Narrow band, and Narrow Banding is more efficient being digital, so there is more to the story, also Public Safety cannot encrypt 100% of its two way radio's, first it is horribly bandwidth inefficient but also because of FOIA, so what you find is emergency operations such as SWAT is encrypted but normal operations are not, in fact a majority of all public safety radio traffic can be heard everyday online on sites like
Broadcastify - Live Police, Fire, EMS, Aircraft, and Rail Audio Feeds...
NASCAR on the other hand has for years controlled radio communications, all the way down to the local tracks, they handle all frequency coordination, they may even record all radio traffic, someone certainly is or we wouldn't hear of this stuff over the last week or so, someone is even recording secondary frequencies as is evidenced by the Gililand comms..
