I can see if they allow smoking and decide if I wish to take the chance and eat or drink there. I can't see the e-coli in the steak.
Government should only intervene when the individual cannot observe and decide the risk for themselves. Any action beyond that is an unwanted intrusion.
I DO NOT need big brother protecting me from things that I am perfectly capable of handling myself.

It's not a matter of smoking, it's a matter of controlling the population through socialism. Like the gun laws. I don't drink diesel fuel for the same reason I choose not to swim with sharks or stick my face in a blow torch. But you should have the right to do just that IMHO, if you like.
Apparently we now have mature adults that are to simple minded to guide their own lives or select their life style. They don't have enough moxie to keep themselves out of their believed harms way. They need the guidance of the great minds in public office to direct their lost souls in the right direction.
I am surprised that some illegal alien has not filed suit since he COULD smoke everywhere south of the Rio Grand.

Yup, the NoGo II dude is all over this. We'll have a fat tax, there already is a junk food tax in CA. Just think what would happen to poor Vlado's beef fest. It still blows my mind that many people don't see the progression: "Don't worry, they won't do that , how stupid . . ."

I'm not sure, but don't you guys in california now claim to have such "happy cows" that produce tastier cheese etc. So you must have quite a few cows too eh? So how do you get rid of your cow "emissions"?

If it was that simple that would be great, but its not.........we are debating a right which we all have that if excericised has the potential to negatively affect those who choose not to do it.

I understand it is everyones right to smoke, i smoke cigars on occasion........but that being said I don't smoke when people around me dont want me to, and I dont smoke when people are eating food. Its vile, disgusting, and rude. Its common courtesy, and if everyone had it there would be absolutely no need for debate. Problem is there is not.

I don't like the government playing Big Brother either. The ONLY legislation I agree with is banning it in restaurants. So please don't read into it any more than that. QC's example of banning it in apartments is absurd. Its your apartment, do what you want so long as it is described when you sign the lease. Smoke in the open public all you want, just be courteous. Its just when it comes to a place of eating, where sanitation is of the utmost importance, smoking has no place.

I am obviously of legal drinking age, so why then can't I take a beer to class with me? Don't I have the right to do so? I am not driving......so why would it matter since drinking is legal?

Well, I'm glad I live where I do and don't have to put up with that silly stuff.
People know if the place around here allows smoking and they make the call to go in there.

Now that is here in Kentuck.
I guess we are so behind on everything, it just ain't caught up here yet. zzz

WOW people I did not think there would be so many repys
I could pick any side on this and be correct.
However I picked bekosh reply because it most reflects my own view.

When I owned a very small business with only two employees We were all smokers at the time. We never smoked in the retail side or the service side. Only in the back room.
But when WA state adopted the the program we had to move
outside the place I was paying $2000.00 a month for.

Just to have a smoke.
Out back set up by me was a smoker for fish and deer
Almost every customer always wanted to know what we had out back.

They never complained about the smoking room / Office..
as long as they could get free smoked deer or Fish.

Same with business.

Let the market drive the business.
My point.

you have a higher risk of falling down and dyeing, than being harmed by second hand smoke,

why would anyone want or agree to have laws placed in effect that would interfere in our personal lives, that is the topic,

just change smoking to frying bacon, or whatever you like, someone's going to say "I don't like it" therefor no one should do it,

if we allow this kind of thinking, when will they make us eat veggies only, no more milk, will cops be able to stop us and check the air in our tires, because if they are under inflated we use more fuel ?

I know people that do not smoke detest it,
I don't drink, and I detest it, should we ban ol' mud duck? NO!

And your response that you are more likely to fall and die compared to have problems from second hand smoke is equally flawed as the hardcore liberal logic.

If that were true, I should know a lot of people who have just fallen down causing death.

In High School two of my best friends dads died of lung cancer. You ming telling them and their siblings that? Lets see, then I have two aunts that have dies of lung cancer, and then my dad had squimos cell carcinoma but he is still alive and well. (2 months of radiation.)

You cannot compare this to alchohol either.....If I choose to drink it doesnt necesarily affect anyone else UNLESS I choose to act a certain way. Same with veggies and bacon. No matter when or what you smoke it automatically affects all others regardless of any choice in the matter.


Like most highly debated issues the answer falls somewhere inbtween.
