She took the easy way out and split it down the middle. In my view it is a wussy way.

I would appeal if it is worth the mental bagagge that goes along with that. He didn't deserve the judgment but I think the issues were clearly over the judges head and she just wussied out.

The thing is, you didn't hide anything and a sales ad is not an implied warantee which she is somewhat alluding to. What kind of idiot does not try to pump the positive about what they are trying to sell in the ad. What kind of idiot does not realize that and realize they need to do the proper due dilligence.

Well, the ruling certainly sounds a bit suspicious. I have found through much experience that attorneys tend to color things with their clients rather than being honest about their situation. Not exactly what I pay attorneys for, but if they were always totally honest their billable hours would go down. I mean what is your attorney going to say to you, "no, you don't have a chance in hell of winning this so why bother." Of course not! Personally, I would not appeal, it is only going to cause you more aggrevation and more money and the appeal will take 5 times longer than the original case, you need to move on even if it means you have to do so with your tail between your legs.

And for you other people who jumped on me for questioning, keep it up, it is makes some people leaders and others followers.

Having a dissenting opinion doesn't necessarily make you a leader. Although you certainly have the right to your opinion.

What she did is not uncommon in civil court. In effect she did not make a decision leaving both parites to claim a partial victory. If it is put before a judge that follows the letter of the law I have little doubt that you will win. She just pushed this case through the system hoping that no one would appeal.

My attorney looked my wife and I in the eye and said "I'm not charging you anymore for this than you already paid me", so bill padding is not an issue.

He also said "you can appeal this, that is what I would do". He's scratching his head on the ruling. He's told us he hates to lose and doesn't lose often. He looked behind him and said "this is Mickey Mouse Court, an appeal would be held accross the street where the big boys play"

An appeal is being filed.

Justice CB Don't roll over and take it. Nothing feels better than winning a battle when you know you're right. Think about how U felt after the ruling Does screwed come to mind? Fight!!!

cmcpherson....the real question is this.....who hurt you in your life? Who turned thier back on you and really hurt you? It's Ok you can tell us.....come on...its ok to cry.....Who hurt you? Who did you disappoint in your life? Are you jealous because your boat does not meet everyone elses standards? Did someone touch you in a way that made you feel uncomfortable?

It's Ok.....Really....Life is just like the airport in many ways....sometimes you just have to leave your baggage behind, swallow your pride...and ride in coach..

Do you need a hug?

Really sorry you're still being dragged through this CB. It in no way sounds fair to either party. An appeal is definitely needed now just for your piece of mind. You might want to consider a counter suit for frivilous claims plus fees and inconvenience once you win the appeal. The kid (and especially his mother), in my opinion need to learn a lesson.

When I was 18 with a nice boat I'm sure I would have run the p*ss out of it just to show off for the buddies. There's no doubt in my mind that's what happened. He either didn't check the oil and ran it WOT for 4 hrs or didn't watch the guages and overheated it or lost oil pressure causing it to Kack!

But then again, my parents never would have let me spend $4200 on a used boat when I was 18!!! They had a lot more common sense when raising their kids.

This is a prime example of a totally inappropriate post. cmcpherson is entitled to state his opinions without fear of harrassment, which is exactly what you (Grunt_Sculpin) have done. cmcpherson did not attack any member here, but at least two members have attacked him.

If you don't like what someone posts, post a rebuttal, don't attack them.

I can't believe this. Next time I sell something, maybe I'll just blow it up instead. At least that will be neat to watch.

No problem. I too have a dry or odd sense of humor. I learned that not everyone recognized my brand of humor by just reading it. So to be safe, if you are joking around, be sure to stick one of these --> :D on it so members know you are not serious.

this is the reson my wife droped law school and is going to nurseing school the system is broke and cant be fixed do a search on law suits and find the one thats similer to yours and use it for presadence i got lucky i sold a horse and when i walked into the judges chambers there were horse pics every were

Hey CB, don't forget that there is always another option. Remember your NJ roots? Look up some Jersey boys and they'll go visit the plaintiff and make them a settlement offer they can't refuse. :D
