CHICAGO, Illinois (Reuters) -- The owner of a Michigan company who forced his employees to either quit smoking or quit their jobs said on Wednesday he also wants to tell fat workers to lose weight or else.<br /><br />A ban on tobacco use -- whether at home or at the workplace -- led four employees to quit their jobs last week at Okemos, Michigan-based Weyco Inc., which handles insurance claims.<br /><br />The workers refused to take a mandatory urine test demanded of Weyco's 200 employees by founder and sole owner Howard Weyers, a demand that he said was perfectly legal.<br /><br />"If you don't want to take the test, you can leave," Weyers told Reuters. "I'm not controlling their lives; they have a choice whether they want to work here."<br /><br />Next on the firing line: overweight workers.<br /><br />"We have to work on eating habits and getting people to exercise. But if you're obese, you're (legally) protected," Weyers said.<br /><br />He has brought in an eating disorder therapist to speak to workers, provided eating coaches, created a point system for employees to earn health-related $100 bonuses and plans to offer $45 vouchers for health club memberships.<br /><br />The 71-year-old Weyers, who said he has never smoked and pronounced himself in good shape thanks to daily runs, said employees' health as well as saving money on the company's own insurance claims led him to first bar smokers from being hired in 2003.<br /><br />Last year, he banned smoking during office hours, then demanded smokers pay a monthly $50 "assessment," and finally instituted mandatory testing.<br /><br />Twenty workers quit the habit.<br /><br />Weyers tells clients to quit whining about health care costs and to "set some expectations; demand some things."<br /><br />Job placement specialist John Challenger said Weyco's moves could set a precedent for larger companies -- if it survives potential legal challenges.<br /><br />"Certainly it raises an interesting boundary issue: rising health care costs and society's aversion to smoking versus privacy and freedom rights of an individual," Challenger said.<br /><br />So far no legal challenges have been made to Weyco's policies.<br /><br /> What is next? How often an employee can have sex with his spouse, what groceries to buy?

One problem is that when people stop smoking they usually put on weight. Why doesn't he just tell people he doesn't want them any more?<br /><br />I don't mind them introducing mandatory frequencies for sex with the spouse (or maybe the company wh*re if they want to measure it reliably) but it's got to be a higher rate than the normal married bloke's birthday, Father's Day and Xmas.<br /><br />Oops! That'd make sex a work requirement.<br /><br />I knew they'd take the fun out of it sooner or later. Sex, not work.

Its his company, if he doesnt want a certain type of employee working for him, it is his right.<br /><br />Do I like it no, therefore, I would not consider working for him.<br /><br />Ken

he will lose in court IMO. you can't dictate<br />lifestyle to your employees...<br /><br />what's next? too fat, too short, not allowed to<br />drink alchohol, not allowed to drive a snowmobile/<br />motorcycle or go skiing (too dangerous)... etc, etc.<br /><br />if it costs extra for health insurance cuz u smoke<br />then it's fair to make them pay the diff. maybe,<br />but you can't fire them or mandate they quit.

I agree with Ken. Nicotine is a drug. Drugs are bad. ;) <br /><br />This actually reminds me of those stupid home owners association groups they have in certain areas. The ones that decide what you can and can't have in your yard, what color your house can be, etc. My mom had a friend in AZ that bought a house in one of those areas. She ended up reselling the house after living there 6 months because she wasn't allowed to put up a Flag in her front yard. I thought that was one of the most pathetic things I had ever heard.

Insurance companys always looking at angles to save a buck and keep it in their pockets, he will probably get away with it calling it "COMPANY POLICY"

All companies have guidelines to go by, some more stupid than others, but they have them.<br /><br />If you don't adhere to them guidelines, the boss has the right to poof you.<br /><br />If he instituted a "New Company Policy", the employees have to adhere to it or he has the right to say bye-bye, like it or not.<br /><br />Do I like his "Policy", nope, but that is what he is doing.<br /><br />On another note, I can't believe I just used all them big words. :)

In 1957 Nikita Kruschev (sp) the prime minister of the USSR made a statement in a meeting with Einsenhour. "You will become more like us, and we will become more like you" I have to put some creedence in that today. PC mania has become a 21th century socialism. Those smokers already on board should be grandfathered in respect to smoking off the property if it was not a condition of employment when they signed on.

I've never thought that employees make the rules where they work, the employer does. When I heard this I thought the guy is nuts, but the choices should be with the employer. Unfortunately if he only wants to hire the granola sort of gymn rats he's really in trouble, you need a fat slob with a stogie hangin out to keep 'em out the "john" where the mirrors are, where they would spend their work day if they could. Chief :D

Hows about a "no pants" Friday? Or a "Topless Tuesday" for all employees regardless of gender. The logic is the use of peer presure to get the fatties motivated by the granola crowd and trim the blubber. <br /><br />Also, mandatory enhancement for those less than well endowed, regardless of gender.<br /><br />Rediculous hey!........so is this dude Howard.

I think it depends on what his company does. As a business owner, he has an image and a reputation to uphold. The condition and appearance of his employees is an indicator of the quality of his business. I can use my own place of employment, pest control, as an example. I myself am of a presentable weight, condition and appearance, and I do not smoke or behave poorly around the customer. I also have the highest customer satisfaction rate in the company, and bring in the most money. <br /><br />We have had fat, unkempt, smokers work for us, and they have always performed poorly. They can't work as hard, the customers are not as satisfied even if a good job is done. We send satisfaction cards to our customers, and the neat, trim technicians get high marks, the sloppy fat smokers get poor marks. Like it or not, in todays world, you are judged on the initial impression you give, and it will always bias the opinion of you despite the actual quality of work you perform. I don't like it, but thats life.<br /><br />If this guy wants to implement his policies, let him, its his company. If people don't like that, they can start their own business and hire all the fat smokers they want. At least he is being up front about it. If he wanted to, he could just selectively fire all his fat smokers under the guise of poor job performance or anything else. Employees always give employers excuses to fire them, it is just luck that they don't get fired. I am a great employee, but even I could get fired at least once a month for something.

how does the customer know the person smokes?<br />what does % of body fat have to do with a persons<br />ability to do a job or give good customer service?<br /><br />can you say "clone"...

He should not be able to force people who he hired on before his policy change to be under the new policy. But other than that, anyting goes as long as it doesnt violate EEOC.<br /><br />Why do you guys think the government should force this guy to hire people that he doesnt want?<br /><br />Which is worse?
