I am going to see how this plays out in the next day or two. I have no idea what Starcraft is going to say.

This has been said for about 2-3 weeks. I am rooting for you, but you have to stop being so forgiving and patient. Sometimes to deal with problems you have to BE that a**hole. This wasn't a 100 or 1k purchase for a tv. Go get em Rico.

I just don't understand why you keep bringing up the warranty and whether or not the boat should/should not have one. This doesn't even matter in the slightest bit, and the more you bring this up to the dealer the longer this is going to take to get resolved

Amen! Tell them they breached the contract and DEMAND that they make it right or they can deal with your attorney. Enough back and forth with them. It's time to crap or get off the pot as they saying goes.

richo......i strongly agree with the above.

if the issue of warranty is brought up......it gives them an avenue to get out of replacement. and all the longer it will take to get this resolved.

btw..... my buddy is supposed to get back to me today for conformation.

but i suspect he will say the same as me, the dealer bought at a discounted price because it was a factory second....(the EXACT SAME AS YOU FIND AT A LIQUDATION STORE) and sold it to you as a finished product......and they know stock numbers......they knew damm well what it was when they sent it to you.

that is misrepresentation. clear cut.

I'm sorry but you really need to cowboy up. Absolutely NOTHING is going to happen without further action from you.

If you'd like to say it in a friendly way that's fine but you need to say (at minimum) "I have found out that this boat that was sold to me as new was in fact a cosmetically damaged factory second with no warranty. Whether or not this was an accident or deliberate fraud, this is not the boat I paid for so I'd like return the boat and void the sale. If this is not acceptable to you, then I will be speaking with a lawyer to determine what my rights are in this situation and you will be hearing from him."

I didn't get any calls today but the point raised about the warranty is interesting. ...

What? No call back? Are you sure your phone is working? I am so shocked that they didn't call back! Maybe they had a fire? Power outage? Death in the family? it's almost like they are stringing you along....

And it's not a warranty!!!

Try "non-conforming goods" on your lawyer. Or theirs.


Grow a pair. You are losing your case every day. I know how this works--the patient guys, when they get to court, lose b/c they didn't act fast enough. Your equivocating is eroding your position; you are proving that it's not important. The other side will say, can't be that bad; he didn't do anything for months. No demands, etc. Have you given Notice with a capital N? See UCC article 2-607(3)(a) "...failure to give timely notice bars the buyer from a remedy...." as an example of an issue of what might apply to your case--can't say for sure....

Like the others trying to help, I'm dying here. I deal with these things in real life and I'm going crazy. With time passing, I'm starting to like the other side's case better.

One last thought--someone said the dealer is sponsoring a big fishing tournement. Maybe you want to be parked there with appropriate signage on your boat???

How would this work?. A letter to the dealer (certified) saying.. "Dear sir , I just bought a NEW boat from you and evidently there was some confusion on your part and you gave me one of the blemished discount boats you got from the maker by mistake... I know mistakes happen so I am returning the wrong boat and now expect you to give me the one I purchased ,,thanks Get that wrong boat back to the dealer ASAP. Then it is 100% his problem. By the way a 3 way telephone call IS NOT GOING TO HAPPEN..

I got a call from Smokercraft/Starcraft this morning.
I'm not going to go into particulars, but the fellow I spoke with understood what has happened. Although there is no explanation for the boat leaving the factory in this condition he does not want it to remain in this condition. This boat was not a factory second and none of the boats in that shipment were. And it will go back to the factory to be refinished and the warranty honored.
So I can put my numbers on it and use it for the season.
At the end of the season I will deliver it to the closet dealer. Starcraft will take the boat back to the factory and refinish it during the winter. They will bring the boat back in the spring and I can pick it up.
I need to finalize the small details about winter wrap and which dealer I will be taking it to. And I've also asked for a copy of this agreement.
Port Colborne Marine also called and I am satisfied that this indeed was an error. This boat somehow slipped through with these defects and Starcraft is standing behind their product 100%. Besides a bit of driving, and a few emails, this should get sorted out this fall.
I think my gut feeling was right. There is no reason a well established company would sell a factory 2nd as new and risk their reputation on a single transaction. The sales staff didn't know what was under that wrap and it should have been inspected at the factory.
And Smokercraft/Starcraft is stepping up to make this right. Shipping a boat there and back is not cheap.
With this resolved I can get this boat wet and go fishing.

I dunno. I guess if that makes you happy that's what counts. I'd have held out for a replacement. StarCraft and the dealer needed time to get all their lies in a row. Bottom line is you bought a defective boat, and nothing less than full replacement would be acceptable to me. When you sell it in 10 years will you disclose the damage?

Sounds good and congrats on the resolution.

I hope you somehow took into consideration how any damage, as minor as it may be, during the boating season will be handled. It would really suck for you to put a minor scratch in the boat and have them turn around and say that they will not fix it because there is more work than they originally signed up for.

Just something to consider.

If you are happy and satisfied, I guess that's all that really matters. I would wait until I had it all confirmed in writing before splashing.

I have it in writing and so will the dealer.
Will I disclose the fact that it was repainted by the factory? Why not? I felt the corrsion appearing around the rivets was a bigger problem than runs and dust and he said they would repaint the hull to fix that. Its impossible to paint little spots all over a hull and make it look good. I don't feel like the dealer or Starcraft were lying. Both sounded very concerned about public perception of the product and the warranty issue. This boat has full warranty as per my bill of sale.
Am I satisfied? Yes.
Do I wish the boat would have been unwrapped and was problem free? Yes. But it wasn't and life goes on. Would I buy again from Port Colborne? Yes. But no matter where I buy from again I will unwrap and inspect what I'm buying. Even if I have to pay to have it wrapped again.
Bottom line is it will be repaired, and the dealer and Starcraft are standing behind the product.

My Humminbird 597ci HD DI arrived last night. So I have to get busy with that and get this boat fueled and run for a few minutes on the muffs.
Time to concentrate on the good stuff. Paint can wait until this fall.

I think you have a very reasonable perspective on the whole thing. I'm glad it worked out and you get to go boating. I know what a drag it is to buy a boat only to get entangled in this sort of stuff. Congrats and enjoy your boat!

BTW, re your new combo charter/fish finder. Navionics has a 2 for 1 sale on their new $99 Marine & Lakes chip, good thru May 28th. I think it's the same maps as their Navionics Gold chips, but for a single state only, not the whole USA.

You get a blank chip and download the maps for your state. Coastal/bay data too, if your state is on the coast. Get the free chip via rebate. Sell it on ebay, or use it on your spare boat!
