I agree that the system does not work ideally, David, but it is still the best system in the history of civilization.<br /><br />It is too much about winning and not enough about justice. I've said that before.<br /><br />You are probably right that it takes money to win and poor folks often get the short end of justice as well as the short end of "winning".<br /><br />Given that rich folks, or folks who get the attention of the media, get a more even playing field with publicity and vote hungry prosecutors (remember, they are politicians and bureaucrats as well as lawyers) they win more often than poor folks. That doesn't necessarily mean they "get off". It merely means they won.<br /><br />O.J. is an excellent case study. He got good enough lawyers that the prosecution had to PROVE he did it. They failed. That doesn't mean he didn't do it; it merely means they failed to prove it.<br /><br />So far, the Innocence Project, with good lawyers, has proved the innocence of over 70 people convicted of rape and/or murder, including many condemned. I think that makes your case. . . and mine, too.<br /><br />Small town lawyers and public defenders are often rookies put in the arena with major league heavy hitters. Not fair in my view, but how does one fix that?
