I will not set it forth again.<br /><br />The court has the right, not the police to issue a warrant. In doing so the court has the authority and responsibility, yes under the Constitution, to limit or direct the requirements of such warrant. For the police to overstep this is adverse to the rights of search and seizure. <br /><br />Sorry, but for my dollar that is a violation of my rights under the Constitution and therefore unacceptable, contemptable and mostly ILLEGAL.<br /><br />Pointer, I happen to handle my weapons quite well but you or anyone else with no better sense than to knock down my door will likely feel the efforts of my defense of family, self and property with all my ability.<br /><br />Unlike you I am not a pick and chose conservative, anytime the government (this one or one under the demo's) takes my rights I am 100% behind their removal from office. This country was not founded and fought for to support the rights of a few wealthy, corporations, give government rights and protect the federal establishment from the rights of the individuals and the States to govern themselves. No sir I am a full fledged conservative.

It has nothing to do with being PC.<br /><br />As for you declaration of conservatism, welcome to the party. But conservatism has little or nothing to do with a persons income, business holdings or position in life, it has to do with individual freedom from government. By big government, we have lost much of our states rights to federal jurisdiction and overly broad definition of "rights". We don't have a right to healthcare, air conditioning, a job, etc. We have the right to earn them in the way we all individually see fit with minimal government interference. Not your pick and choose BS about big corporations, the wealthy, or the boogieman. Conservative is a political view not an economic one. When you get into class warfare and envy is when you are swimming in the liberal end of the pool.

Unfortunately, bad guys are using the same announcement before crashing into someones home. You can't tell the JBT's from the druggies.<br />As for taking out some JBT's first, you may get one, but they WILL shoot you and your dog when they see a weapon in your hands! You won't be left standing.<br />The danger is that there will be more incidences of loss of life on both sides as the JBT's take advantage of their new freedom...and they will!<br /><br />CD

They did announce themselves. Otherwise, how did the dirtbag know that they announcd themselves but didnt knock?<br />And again, the 4th ammendment DOES NOT SAY **** ABOUT KNOCKING ON THE ****ING DOOR!<br />If you want to argue that they should knock before entering, fine. But dont claim that its a violation of your rights, cause it isnt. But, please show me where the 4th says that you must knock first. Id love to see it.

cpj, Show me where it says the police have a right to issue warrant. I believe it is the power of the judicial branch who can put limitations in the warrant. <br /><br />If Judicial warrant says "knock" then you must knock, if you do not knock then you have violated a citizens constitutional rights. So the cops should be knocking or evidence is not admissable.<br /><br />If you do not agree why bother with a warrant, the cops think a house is where a bad guy might be just knock down the door go in and see. Sounds like a great law to me. That way everyone could be checked, hell we might even catch someone committting a illegal sexual act in their bedroom.<br /><br />Remember the Constitution guarantees the rights of the people, not the power and rights of the government. It is all about the "OF THE PEOPLE, BY THE PEOPLE, FOR THE PEOPLE."

I myself am a lot more concerned about the ACLU rather than the police. I agree with Twidget that there are some bad cops but for the most part the over whelming majority of them are good guys and gals trying to do a thankless job for a bunch of whiners. I would bet a sizable amount that most of these hand wringing liberals would be the first to chastise the police if they were in a situation that required immediate action and the police didn't respond immediately.
