My farmer neighbor and his wife are in their 50s, great people, active in the community and the sort that want to give back. For the last 10 years or so they bring 10 to 12 kids from the inner city (Kansas City) to their home/farm for a couple weeks in the spring just to let them see there is more to the world than concreate and that country living also has its advantages. (Not sure which group they work with but its a partnership with the K.C. parks.)

So this spring they brought the kids to their home. Things went fine, all the kids had a great time and all said they would love to come back. Until they got back home that is...

The mother of one of the kids had a fit because while at the farm her daughter was allowed to watch the birth of a calf (all the kids were) and was upset that the childs work clothes had the smell of manure on them. (The girl is 12) She complained to the Parks folks, the city and anyone else she could corner long enough to hear it. Basically, everyone told her she was way out in left field and no one did anything.

So yesterday the farm couple are served papers saying they are being sued by the mother for the emotional damage done and has filed a formal complaint with the state DHS because it's inappropiate to allow a child to see a calf being born. (I guess she believes it's sexual in nature.)

I don't think the case stands a chance but its still going to cost them to hire an attorney to answer the suit, time and effort to defend themselve's and in all likelyhood his insurance folks are going to have something to say.

I can almost understand the mother being this silly but come on, a lawyer should know better and never filed such a case. My opinion, there ought to be a law,,, with very sharp teeth to prevent this sort of thing.

I would like to think that the organization KC Parks would step in on this. Surely they have lawyers on staff or retainer.

Some people just look for ways to earn a free $, and today?s attorneys seem to encourage this type of poor behavior. Just look at what they advertise on TV and in print, it?s enough to make you sick. So what this child is really learning isn?t a very nice thing at all, she?s being taught by her mother poor judgment to sue people for no dam reason!

Just remember, life isnt perfect.

Wow, that is simply outrageous. We've become so litigiuos in this country
that you can't fart in your own bathroom without fear of being sued for noise
and smell violations.

The problem is, and will always be, the people who write our laws are lawyers.
They always talk about "Tort Reform" but if you notice, after election, it's never
brought up again. And, it doesn't surprise me some "low-life" lawyer would
take on this claim. They're everywhere you look. In every corner of every
city. Think about the # of "1-800-ASK-GARY" commercials on TV, etc.

The true sad part is, their insurance company will probably offer this scum bag
woman and her atty, a small amount of money just to make the case go away.
And, that means it was all ok to sue in the first place and the process will start
over and over again. Truth is, a Judge should look at this case on it's merits,
not only dismiss it, but immediately file Judgement against the Plaintiff for
$50,000.00 for a frivilous lawsuit, payable immediately by her attorney. Do
that enough and this stuff would stop I assure you. Sad state of affairs and
even worse, sad for a bunch of kids who will now never get to experience an
alternative life because I'm sure the neighbor will stop having them out.

Those folks should have received a letter thanking them for taking the time and effort to give the kids a chance to broaden their horizens.

This lawsuit sounds ludicrous and I hope it never sees the light of day.

Maybe a like-minded(ie. rational) attorney will be able to help pro-bono?

That the way it is now Lookn for easy $.. It reminds me of the lawsuit a few years ago. An airline stewaress was trying to get everyone seated for takeoff. A couple kids were argueing about what seats they were going to sit in. The stewardess said Eany Meany miney moe-pick a seat we gotta go.. She then was sued by 2 other employees for the raciest slur.

For My 100# post. It is a shame to see no good deed go unpunished. I grew up in Detroit before moving to rural Tennessee, and can remember as a child getting to spend a day on a farm and it being an exciting trip with my mom and dad. I can still remember watching a farmer milk a cow (I got shot on the shoe from a stream of milk), it was a big joke for my family for many years. As a child I said thank you for that experience of being able to go see something other than just city. That was well over 20 years ago and one of the best things my dad did for us was move to the country later, but maybe we should go back and file suit against the farmer for giving me a memory to hold on to for life. Ohh and really good news my son is 6 and anybody want to guess where he was last week? That's right he was on a farm he was helping to feed cattle and horses (we have a family friend who has a working farm). This kind of crap is proposterious.

The best thing he can do is call his insurance company they will deal with it, and unfortunately that may be the last set of city kids who get to see what a farm is actually like. Tell your friend though to take heart I am sure he helped to create memories that several children will cherish forever.

I would be willing to be that the kid had a great time and would love to do it all over again. The kid was probably excited telling her mom what all she got to see and do, and now mom has seen an opportunity to make a quick easy buck. It is just disgusting.

I hope Parks helps out with a lawyer. Sadly, anyone can be sued for anything. The use and abuse of law is a storefront business that seems to be doing well. Hopefully a judge will throw the case out, but remember, its just business to everyone but the defendant and the accuser.

Most of those intercity kids have seen alot worse, i.e. people getting shot or people shooting up. Guess next summer she will be playing in the street and dodging bullets.

If I was that farmer I would want to use my liquid manure field distribution trailer in an urban setting.

I wonder who she would sue if her daughter witnessed a squirrel being born outside her window?

I would hope seeing a calf born wouldn't harm anyone, but then, I had veal parmesan for dinner last night.

A question for all. I see absolutely nothing wrong with a 12 year old seeing a calf born, in fact I would go so far as to say its a very positive thing.

What say the rest of you?

I'm with you, Bubba; 100%.

As far as the frivolous litigation goes, have your neighbors considered a countersuit? They have to hire a lawyer already, might as well make him work for his fee.

Maybe your neighbor could pay her a visit on his big green tractor....could also swing by her lawyer's house while he's in the neighborhood.

I think I was 6 when I saw pigs born. Dad raised pigs. We moved off the farm when I was 7, so it had to be earlier than that. Fascinating stuff. I was older when I saw calves, maybe 10.

Re: Grrr... Law Suits - stuck on stupid plantiffs

Realistically Does anyone REALLY think the parent of the girl is REALLY and HONESTLY upset that her daughter witnessed the miracle of birth ? HELL NO!!!!!!! She is just looking for easy money by abusing the legal system for her own personal gain..At the expense of some generous couple that did her a favor... Same with the lawyer.. IMO she- and the lawyer are just a money grubbing POS &#$@^sub standard human beings !!! To hell with em ! Once again IN MY OPINION!!!!!!!!!!!!!!!!!!!!!!!!!!!!!Did I remember to say IN MY OPINION!!!!!!!!!!!!!!

The mistake for the farmer is to run to his insurance and expect a defense which will not be defense.

Face the silliness down in court alone, you don't need a lawyer to take a stand on common sense, in fact you're better off without one.
I would call every newspaper and radio station, put the spotlight on the judge. This stuff is on every nature program on tv.
