Captaining a vessel no matter where or what kind it is there are rules and laws set forth for the safety of ALL who enjoy the waterways.The international regulations for the prevention of collision at sea...(COLREGS)..r said rules of the road for the waterways...The us inland rules govern us great lakes bays rivers inlets and any/all water ways that connect to the sea....The 2 sets of rules are identical in all aspects....meaning they apply the same way no matter where your at!!! the purpose of the rules is NOT to grant one boat the "right a way"..AVOIDING a collision between 2 boats require PARTICIPATION of BOTH.Rather how to ,in ANY Situation, avoid a collision and for the actions BOTH vessels must take.....Note the following rules apply to situations where no more then two boats are involved.......THESE RULES APPLY TO ALL VESSELS ON THE HIGH SEAS AND NAVIGABLE WATERS CONNECTED TO THE HIGH SEAS AND THE U.S. GREAT LAKES

That is RULE number one...rule#2..... NOTHING in the rules exonerates any vessel or its owner master or crew from the consequences of neglect to comply with or to take precautionary measure to avoid circumstances that may arrise.....rule #3.... UNDERWAY=not anchored grounded or otherwise atteched to shore .a boat does not have to be moving either through the water or over the ground to be underway......RESTRICTED VISIBILITY=ANY condition other then night that reduces visibility,including FOG and HEAVY RAIN.........Rule #5....LOOKOUT=EVERY VESSEL must at ALL times maintain proper lookout by all means available in prevailing conditions and circumstances so as to make full appraisal of the situation and the risk of collision...Rule#7....EVERY vessel MUST use all available means appropriate to the conditions to see if risk of collision exists.if any doubt... risk must be assumed to exist...All Vessels unless anchored or otherwise attached to shore...MUST take any/all actions to avoid a collision by all means appropriate and available.....

some thoughts I have,

both are underpower
one boat has a smaller motor than the other
one boat took measures to alert the other and eventually took evasive action
one boat was IMHO not under command (The term "vessel not under command" means a vessel which through some exceptional circumstance is unable to maneuver as required by these Rules and is therefore unable to keep out of the way of another vessel)

one boat going northwest and one going north. therefore, one boat is stand-on and one is give-way. the stand on signaled maintained and avoided. Giveway didn't because it was not under command.
Give way was NUC due to negligence and not to being broken.

Giveway boat is at fault IMHO.

If the giveway boat was broken, then it was an unfortunate accident....?

reread my post above no one boat is deamed give way boat or stand on boat.........and allow that to show fault????..... if 2 boat coming at each other were to take what you said 2 heart we would be fishing for dead bodies instead of fish. SAFETY is EVERYONES place...... if your not part of the soulition..... your part of the problem. Vessel not under command= A vessel unable to move as required by the rules,due to mechanical breakdown or any other reason................ONE of these boats was on autopilot the other TROLLING both underway....neither had lookouts.......fault lies on both......oh one more for you..............Vessel restricted in ability 2 maneuver= a vessel due to her WORK cannot maneuver easily......ie tugs towing,bouy tenders,dredges ,dive boats, mine sweepers, no where does it say TROLLING........

Offshore, the guys on the trolling boat said they saw the other boat coming at them. I think that would qualify as "having lookouts". The trolling boat did maneuver, just too late. Just facts, no judgment intended.

Does auto pilot also always come with Radar? If you are not at the wheel and your boat causes an accident, it's rather obvious you are at fault. 20 feet of sight because of fog, running auto pilot 18-20 knots is about as ignornat a move as I have ever seen.
Fishing boat did nothing wrong, but the guy who made a series of obvious mistakes will be paying dearly for not being in control of his boat. He's very lucky he didnt kill anyone with his mistakes.

I think you need to go back and take a safety course. Read up on overtaking another boat. The fishing boat was the "stand on boat". Every boating regulations book I have seen clearly shows that.

Offshore was just pointing out the captain of the one vesel was under auto pilot and no watch posted doing somthing other than watching what was going on. The smaller boat was trowling and fishing boats do have right of way under rules of the road

Rule #3 key Definition(s).....Vessel engaged in fishing= Any boat fishing with Equipment that limits its ability to maneuver as in ie...nets,trawls,cages,longlines,etc as in commercial..

I think you need to go back and take a safety course. Read up on overtaking another boat. The fishing boat was the "stand on boat". Every boating regulations book I have seen clearly shows that.

I guess if you run right up the back of another boat it'd be his fault for not getting out of your way. And by the way, I just took the class with my son, I know the rules, the fishing boat was the stand-on boat.

Can't believe this is even debated! Radar, auto pilot, GPS all are navigational aids and do NOT release the captain of his responsibility to safely operate his vessel. By not watching where his auto piloted missile is heading he broke a cardinal rule of common sense and basic boating laws. That action might be OK if there is 20 mile visibility, NOT fog, and you are moving at 10 knots and plan on coming back to deck in no more than an hour to again visually confirm of no other traffic. As was stated the fishing boat did try to avoid the collision when it became apparent and sounded horns plus changed course. No where is it required or expected that if such action is unsuccessfull it is your fault. That is like saying "sorry I killed your father and son but my $.02 fuse burned out on my radar so the boat did not do my job and it is not my fault"

First off im from jersey..... second ive been on the waters all around sandy hook and surroundings areas....out to 100 miles for over25 years.Ive been a marine mech. for over 15 years certified...Ive done every thing from fluke fish to tuna fish....from working on tugs ferrys and offshore quahog boats to rowing down the delaware.....third you must be one of those guys who thinks they dont have to move because the rules say so and you just stay there looking at the other guy not taking your crews SAFETY in mind......forth.. I, nor do You, own any open waters any where. I guess you dont have alot of common sense and realize that there are some real retards out there and because you have some paper thats says you can read a book and pass a test,you think its ok to just stand on..dont know about you but if i see any thing coming my way i dont care if i got tunazilla on im making prepartions in my head so my crew and i are safe.Do me a favor if you fish in sandy hook area let me know what boat your on so i can steer CLEAR of you Captain!but im sure ur the guy with the white glob of stuff on ur nose................Maybe ask your son what he thinks about the crash??????

ok....When they saw the other boat carelessly crusing up on them ....they were under power(trolling).........why wouldnt they bump up the throttle a little faster?????(i sure would of and if they did they wouldnt be where they are now!!!) they saw it coming you even said it your self!!!!!!! Not putting blame solely on him......however if he would of take his actions 5 seconds sooner well he would still have a boat.. must have watched it for a bit to realize whats about to happen then sound a horn,then change course ,????ummm makes you think

Actually the the original report says "trawling"....the guy was towing a trawl net and if that is not a case of "a vessel due to her WORK cannot maneuver easily." nothing is.



what was that important? for him to not take evasive actions? if he was trolling? wasnt he was driving the boat?or was there also no lookout on that boat also? I am not here to raise any ones eyebrow or any thing like that,what i am trying to do is to let every one know that the saftey of you and your guests ride solely on the captains ability to have control of your vessel at ALL times!!! even if it means letting the other boat have the right away even tho you have it.MANY of times i personally have took action to avoid disaters at sea have you ever fished the jersey shore?

Otherwise you wouldn't be in here explaining why most of us are wrong and you are right....and of course in an Internet Forum everyone is a Master Mariner until they prove otherwise by posting idiocy.

Anyone who claims all that you have and doesn't understand that a working trawler is almost a sitting duck in that situation is just trolling. :eek::confused::rolleyes::facepalm:

BY the way i was Not putting blame on one or the other. I read All of your posts and it seems a few of you guys need a refreasher or a dose of common sense!!!...I was just informing you on what the rules stated and you not only argued with me which your ALL WRONG about! one of you tried to attack me personally with direct comments to me. I was being nice and giving you the rules stated by the uscg.Seems like some of you needed that....I take it personally when someone attacks me i will not do it to any one of you and i WILL not allow you to do it to me......I will put you in your place as fast as i can type and trust me it will hurt your egos.....Again if you go back and read every post you will see what i was doin was just informing you..............Again go back and take a refreasher course for not only your safety but... The report i READ said the boat was trolling for fish not a trawl.That is what was written in the report i read.............

It seems to me your the know it all attacking some one who only stated facts..... every one here could look it up and see for them selfs how stupid you are for attacking me when there all facts written down in the books and you called me the IDIOT??? before you try and go after some one who has (most likely years above you) what i learned through the years and by experiance on the waterways ....go grab your stupid test paper and diploma and a rules and regulations book by the uscg and then come at me!!!!!! and youll see what im all about...

LoL, last word before this thread gets locked. Blaming the fisherman is like blaming a guy crossing an intersection for not jumping out of a way of a speeding car with cruise control on while the driver is tying his shoe laces. Truth is none of us know all the little details that investigation will reveal. It would be nice to see what actually happened and who did what per the report. Only real thing that can be learned from this article is that no one should put all their trust in our gadgets and there is no substitute for common sense. Peace out.
