Also when you sell a boat and put as is on the bill of sale and let them know about the motor and stuff how can you be sued if you say it is as is.

Most Lawyers are creative, bright people, who will work any angle they can to make a case. Heres a scenario; you sell your boat to a Joe off the street who buys it as his first boat and takes his kids out on the water with it. The "stringers" you put in for some reason fail, and the boat folds up like a card table. Yeah you sold the boat to the gentleman with "as-is" written on the bill of sale, but geeze with that sunny ad you put on craigslist representing the boat as having a brand new deck, why would he have though that the deck may have been any sort of problem, and subsequently had it inspected?

I'm not trying to be difficult but you could sell a boat that is about to break in half as is and not get in trouble.

Are you a lawyer? You know all the ins and outs of RI law? Can you afford a lawyer?

I know what you are all saying but this boat is sold. i put the boat through the paces a week ago in 4' waves and 25mph winds with 4 people on board and the boat ran good.


So what? You drove the boat for a total of couple of weeks and it didn't break apart yet. You still put the boat back together in a way that nobody on this forum or a marine restoration professional (which includes many members of Iboats), would agree to being proper or safe hull repair.

May I also point out that the boat doesn't currently run good, and may need much more at this point than a heli-coil and a carb rebuild.

Bottom line, You need to de-gloss your ad on CL.
You want to use as-is for your window out if/when something goes wrong, then it needs to be stated right off the bat in the ad.
You need to disclose that the deck was installed as a project by an in-experienced boat builder, and it may become an issue.
You need to disclose that the motor was running like crap and died before the spark plug threads became an issue.
You need to disclose that the transom should be inspected by a professional along with the trailer.

Anyway, if I were the plaintiff's lawyer representing the remaining family members of those who drowned in your boat, i would be using that statement to show that you knowingly sold a boat that was recently abused.

The more you say, the worse it gets. As usual.

SBL,
Read the thread that iboats member oops put up about being sued. Oops did nothing wrong BTW however it tied him up for about 3 years and legal expenses.

Take heed. In this case it would be your parents, with you in tow, getting a summons to appear before a judge.
Can they afford court and lawyer costs?

There's a difference between an unexpected failure and structural instability due to your hidden changes in the structure of the boat. That glassed in floor you talk about hides the fact that your stringers go the wrong way, you've been told that multiple times and continue to ignore it. Now you're not only ignoring it, you're being misleading about it. That's how you can get sued, actually your parents get sued....because it's called negligence and deception. One run in "4 foot waves" is not equivalent to putting it through it's paces.

Nothing wrong with selling a project boat on CL, I have done it.

I think the real issue here is the structure of the boat has been compromised, due to you redesigning it. You removed or changed the way the boat was built, put a solid floor (no veiwing access below) over the top and appear to be claiming it is solid and ready for the ocean (once the motor is fixed).

I don't claim to be a lawyer, so I can't comment on you being sued, but would you feel well if you sold this boat to a guy who took his young kids out and the boat fell apart around them?

SBL, please do not take the structural changes you've made to this craft lightly! The stringers in your boat are dangerously wrong. Fiberglass is not THAT strong and having the center stringer along the keel along with others beside it is what makes the hull sound.
Forgetting any legal implications, if you sold this boat to a young family and they took it out and the hull failed and their child died, could you live with that guilt? I know I couldn't.
This is a very serious situation.

Wow this kid is going way too far with this. I honestly don't get how he can pass this boat off as sea worthy once the motor is fixed and not feel like a complete douche about it. Seriously SBL do you not have a conscious? What if some little kids get hurt in the bay with this thing? Think about what the heck you're doing man. There are so many knowledgeable people on this forum that have CLEARLY tried to help you restore this boat for your own enjoyment. If you're going to sell it AT LEAST list it as a project boat and not a boat that needs "a quick fix to get it going again". That's so wrong it's pathetic, I hope you realize karma will get you back for this without a doubt. Don't think I'm trying to be mean because I'm not at all. I'm just concerned about what's going to be the effect of this.

DUDE.... how many of these threads are you going to start? Nobody can tell you what you need to do to make yourself happy..... If you like the boat and are willing to work on it then keep it.... If not then sell it as is for next to nothing. Get what YOU want.... Who cares what we all think is more fun

I don't even know where to start on this. Look SBL I'm 24 years old, young like you. I brought a used cheap boat was I was your age and it was a total mess. I had to end up scrapping it cause it was so bad and couldn't allow myself to sell it to someone else. Since then I've owned a few boats. Sell your motorboat and use the current sailboat you have. Sailing is your passion and you mentioned before. Get a decent job, work hard and SAVE your money to buy a decent sailboat. But be smart. Don't buy another complete resto boat that puts you in over your head again. Work hard, save up and be smart and you will be off to a nice boating life. I know it hard being young and just wanting a boat. But not be smart about your buying decision will make you hate boating in no time. Everyone here was young at one point and we understand how it is. But listen to the advice given, we've been there.

well I didn't know about the shoddy work on the hull.... I CHANGE my suggestion.... DON'T sell it and DON'T keep it... haul the deathtrap to the landfill and try to fix the engine then sell the engine and trailer. This is EXTREME

ya who ever posted that is a douche thanks a lot doensn't matter to me. i'm going to work on the motor make it work again put it back on the boat take if for a ride make sure every thing works and then sell it an i will be able to take them for a test drive. you can't say that the boat is a death trap if it works great and nothings wrong with it. you guys gave great advise on putting the deck in but after i was already told to make ribs for the boat and the ribs work great.

I saw what you posted showing the framework under your decking. It is not set up with proper stringers along the keel and parallel to them. Boats don't break in 1/2 from left to right, but from front to back, because that is where you are putting the pressure. Not to mention the fact that you know the transom is rotten. Good thing the motor needs at least work on the plugs' holes and the carbs or else someone may be fooled into thinking they're getting a good deal.
Thank you SBL for posting detailed pics of how a boat resto should NOT be done and thank you iboats forum for keeping an eye out for unknowing clist buyers.
