I think as the buyer you are the driver so to speak, lke the policeman as a witness in court, your say has the most weight.

PayPal and eBay (I know eBay is n/a in this case) seem to have a bias towards the buyer getting the better consideration. I experienced this as a seller once when my shipment literally felll out of the airplane and they delivered it anyway. Problems arose because it went to Nova Scotia, and I had let the buyer talk me into putting more items in one big box than I usually allowed. He tried to work with me first, I think because he knew what PayPal would do, meaning side with him and he gets to keep all the broken stuff AND get purchase price plus shipping back. I was just sure he was conning me so I filed and lost, kinda funny because he was trying to warn me and turned out to be an OK person. Less than $200 but still I had other buyers and went the wrong way on the buyer's pitch.

I have had to file a few paypal claims over the last few years and I always get my money back or get my item, despite the rising tide against them, they actually do quite well at making sure you get your product or get your money back.

I agree. Paypal is great to work with on claims and has always treated me right.

You can open a dispute:
A buyer asks for a seller's help in resolving an issue with a transaction. in the Resolution Center Located in My Account, the PayPal resource for resolving issues between buyers and sellers. To contact a seller directly and resolve A buyer and seller come to an agreement and close the case, or PayPal comes to a decision and closes the case. a problematic transaction. You have 45 days from the payment date to open a dispute. Common reasons for opening a dispute include:

•You paid for an item but haven't received it and the seller is uncooperative or non responsive.
•You received an item that was significantly different than described



You and the seller have 20 days to resolve the dispute or escalate it to a PayPal claim A buyer or seller asks PayPal to review a dispute and decide the outcome..

The seller reviews your message and replies in the Resolution Center. This is your opportunity to communicate directly and resolve the issue by exchanging message posts. Communicate clearly and include suggestions about how to resolve the issue, such as through a full or partial refund.

PayPal can view all posted messages in case the dispute is escalated to a claim.

We place a hold Restricting the funds associated with a dispute so they cannot be withdrawn from a buyer’s or seller's PayPal account. on all funds related to the transaction until the dispute is resolved or closed.

I research Paypal and it looks to me like sellers on Ebay have the most complaints about the System

That is because ebay forces you to accept paypal if you want to sell on ebay.

We place a hold Restricting the funds associated with a dispute so they cannot be withdrawn from a buyer’s or seller's PayPal account. on all funds related to the transaction until the dispute is resolved or closed.

Unless of course he has already withdrawn them.

I accept PayPal for payments on my vacation rental when its a last minute rental and I can't get a cashiers check in a timely manner. I immediately withdraw the money when it hits my Paypal account.

It seems Paypal has left the door open for abuse and fraud in disputing claims between private individuals, where a purchase may or may not have taken place.

One thing in the sellers defense, unless it was money sitting in your paypal account for a transfer, paypal sits on the funds for 3-5 business days before the seller sees the funds. there is the delay from pulling from your bank account or credit card before the other party sees funds. I know this from first hand experience both in selling and buying.

Bruce, even if you withdraw the money right away, they can come back and take money out of your bank account to cover their decision, when you sign up for paypal, you grant them authorization to withdraw money from you bank account attached to the paypal account, so if there is a chargeback, they will withdraw the money. To stop that from happening, you need to go to your bank and sign a form that revokes the authorization.

That is why, I have a small account that is only used for paypal transactions. With that said, if they try to withdraw funds and you don't have the money, many banks will hit you with an overdraw fee, it pays to read ALL of the small print, broth Paypal's as well as your banks.

I know this from first hand experience both in selling and buying.

We use paypal to do our billing with our internet company account and the funds are always available right away, unless it is an electronic check, if it is a direct transfer or credit card payment, we have instant access to the funds. Most of our purchases are done with a paypal debit card which we get 1.5% back on every purchase processed as a credit card, if I don't have funds in paypal, my business bank account instantly covers the purchase and I still get the 1.5% back the next month, so far with the 2 accounts we have for business, in the last 5 years we have received over $2700 in cash back bonuses. But as I said, my paypal account that I use with ebay normally only has a few dollars in it, if I make a purchase that is more than my balance, I transfer money at the bank.

Yeah, he emailed right after I sent the money to tell me he got it and ask for my address. That's what's so strange about this to me. It seems if he had no intention of sending the item he wouldn't even have done that. I don't even mind so much that he hasn't sent it. It's just troubling that he's suddenly incommunicado. He never responded to the message I sent when I initiated the dispute resolution so I went ahead and escalated.

Wow! I'm glad to hear it, (serious) so many people I know have had horrible experiences, especially when it comes to buying vehicles.

At least for cars I've notice that the sellers only want the down payment through pay pal. Have bought 3 cars over 12 or 13 years off of Ebay and just use pay pal for the $500 down and wire the rest.

Well, over the weekend I got the email I expected. The guy never responded and they refunded the $500. It's unfortunate, but given the things I've learned recently (rather not go into detail, but let's just say I Googled him) I didn't expect any other outcome. Sigh. Still no drysuit.
