This week my brother was in court over a matter that arose with the sale of his previous home. In the initial hearing several weeks ago, the judge tried to strong arm him into settling with the woman who purchased his home for the full amount of her claim. He didn't. But the bully tactics of the judge and the codling of the woman who brought the case was quite angering. He litterly walked her threw the best way to make my brother pay. I thought he was the judge not her lawyer. And he was downright rude to my brother.<br /><br />Well Thursday the case was heard and my brother won a shallow victory. He won but the judge again walked the woman threw the best way for the case to go her way and told her she could always refile. Nice touch. <br /><br />The case is about the hot water boiler for the heating system that seemed to have failed. Those of you who know me know I am in the pump industry and I provided him with a backup unit for the circulating system. I also provided him with the booster system, washdown pump, pressure tank for booster system, and oil pump for doing oil changes in his boat. Why did I do this? I am his brother and we all live on a budget.<br /><br />Well he decided to leave the pump with the house as his new home has forced air. Several months after she took posession of the home the original pump failed according to her. And the backup I gave him "was defective" according to her repair person. Well I work in the industrial end of the pump business and I know there was nothing wrong with the replacement and if there was it was still under warranty. (I paid 56 bucks for the pump. Yea I got friends in the industry.) Well the repair guy sold her a new unit (replacement pump) and installed it and charged her 600 bucks for the service. It shouldn't have taken more than an hour to do this job. These are inline flanged pumps, and run on 115v. Two wire nuts, a grounding lug and four bolts on the piping. <br /><br />She is sueing my brother because he left her the backup pump, and that to her, is indicitive of the fact he knew there was a problem. This woman had a home inspection prior to signing on the dotted line, and signed off on it. She is basically calling us liars for sharing something we didn't have to.<br /><br />These pumps are mag-drive pumps so unless it was drawing high amps (which it wasn't at the time of sale) there was no way to know if the unit was going to fail. (yes, we could have megged it but I don't carry a Megameter to test pumps that are working fine. And I doubt that would have shown anything if the amps were in line.)<br /><br />Well he won, but the woman has refiled again. And with the free legal assistance from the bench and blatent bias expressed by the judge, more vacation and money to defend our integrity goes out the window. And since existing law, facts, and common sense are in short supply, who knows what will happen this time. Why do we have laws when judges can simply divine what is in peoples minds and hearts and assign monitary values to them. I highly doubt this clown knows the working end of a screwdriver from the handle, but is capable of understanding how pumps fail, and why someone might have a backup. This woman was litterly foaming at the mouth during the case. And she had a female friend who was a building inspector friend who clearly knows nothing about pumps. Nothing.<br /><br />Back into the soup. Anyone want to bet on the outcome. I don't, even though nothing my brother did was improper. :mad: :mad:

it's not about who's right or wrong. it's about who has the best lawyer. money will buy you a win. after all, it's guily untill proven inocent isn't it? good luck to yer brother. to bad he has to go through that, and all for bein nice. bummer......<br />naw, i don't want to bet either. :(

I wouldn't waste my time going to court over $600......<br />Was the house under some kind of warranty? <br />At this point, I would offer her half, and if she won't take that give her the full amount & make her go away.....<br />Sad but true, it will be easier for him in the long run.....<br />Damn Lib judges lawyering from the bench! ;) :D

yep<br /> its all about how the judge feels that day and who has the most money to hire an attorney that cares.<br /><br /> they should just post a for sale sign on the dare county courthouse in my opinion.<br />if your a wealthy person from duck or southernshores your DWI results in some community service, if your working poor from colington,stopped in the same road block, you get to spend some time in manteo and pay 600 Plus in fines then go to community service.<br />just depends on how much ya pay into the "system"

Personally I would have given him 600 just to get him to stop talking about it. But he feels insulted and is very angry about how this woman has tried to make him out to be some kind of liar. He has over 600 into the lawyer just to vindicate himself. Clearly the legal system has forgotten about the blindfolded woman with the scales. In for a penny in for a pound.

I just hate the idea that it is cheaper to pay them what they want then to fight it and be found innocent and right. Pride has cost me a lot of money. Attorneys don't want to go to court, they just want a quick settlement so they can take their third or fees and go to the next sucker that will pay off without a fight. If they would make a law that if you are found innocent or not guilty the loser has to pay all attorney fees and costs then it would solve a lot of problems.

This is a clear case of a repairman milking a client. There is no warranty for house parts after a sale unless they are specifically spelled out in the contract offer to sell/purchase.If a floor starts to creak or a light bulb burns out, TOO BAD. <br />On the other hand the cost of fighting is ridiculous and an offer of half the repair bill with the return of the "defective" replacement pump would be fair. Not right but fair. The judge is an %#$@&*%^ :rolleyes:

It's plain to see there was recorded collusion with a biased court. I would file for a change of venue on her refile ASAP.

Pointer, is she sleeping with the judge it sure sounds like it. Here in the great state of confusion (Michigan) if you go to court without a lawyer your pi$$ing in the wind, the wonderful judges and courts are so busy taking care of their brother lawyers there is no interest in the law, right or wrong or morlity, thats because to be a judge you have to be a lawyer which everyone knows lawyers have none ot these traits. after all being a lawyer is the only profession in the world that the bigger the A--hole the more money you make :confused: :mad: :mad:

Years ago when I got a devorce we had it all worked out all papers signed and everything, I didnt even have to be there. the judge ( a dandy without a hair outa place) tried for ten minutes to get honney to go after me for more. Little twirp creep was only trying to score a little sack time with her. :mad:

Pointer,<br />It sucks i am a one for standing and it costs me heaps, but i have never lost and have great pride when those little **** lawers think they can out play you. i am going thur one now over $60.00 telephone company thur intenet they say i clicked on site and it went thur overseas account.Rang them and guess what cant give me details .I will have fun with this sent me a bill and didnt even know my name.

I know if i paid the 60 bucks it goes away. BUT i didnt use it and they play on us to pay it, when i rang these crooks the so called super told me that this was the 10th complaint today.<br />I WONT PAY AND I AM GOING TO PLAY.<br />I have always paided my bills but will not pay crooks

I know if i paid the 60 bucks it goes away. BUT i didnt use it and they play on us to pay it, when i rang these crooks the so called super told me that this was the 10th complaint today.<br />I WONT PAY AND I AM GOING TO PLAY.<br />I have always paided my bills but will not pay crooks

Can't say about the small claims division, but the jury system seems to work pretty well. So far in jury trials that I've been on, we've sent gun runners and child molesters to prison, let technically guilty people go free (Drunk and disorderly and assaulting an officer) and, unfortunately, sent an innocent bloke to prison for 2 years.<br />The innocent guy was framed by his wife who called police on her way out of town with her lover. He was so bummed, that he didn't have a lawyer and spoke not one word in his own defense. The judge admirably coached him through the trial and asked him, at times, if he wanted to object to prosecution questions. He didn't take any hints. If he would have said anything in his own defense, we would have let him go. Since we could only judge by the evidence presented at the trial, it was all one sided. <br />The coaching was very appropriate in this case and we really felt sorry for the poor guy.
