Starting a charter boat business in California, and I will have 1 employee to start with. It's my understanding that I cannot use a standard workers comp insurance, is this correct? Is Jones Act insurance what I should be looking for? Is the Jones Act insurance paid by the hour the employee works like a standard workers comp or is it set up differently? Thanks for any info

First of all, I am not an insurance expert and really not much of a boater but I am somewhat familiar with the Jones Act. Although there is much more to it, in short, it is the maritime version of workers compensation. If you employ any crew, even one, then you should have coverage added to your policy to protect you from possible liability in case one of the crew is injured due to your negligence. See you current insurance agent, he/she should know a lot more about it than any Internet forum.

Don't think this is a question for a boat forum. You need to find someone that is familiar with Calif laws

It never hurts to ask.

Plus, in my opinion, it will be to your advantage to educate yourself as much as possible before talking to your insurance agent because the more coverage they sell you the more profit they make.

even if you did you would not know if you are getting good advice. You need the advice of a business lawyer IN YOUR STATE who handles both employment and maritime law. A good insurance agent will know, too, so get an agent by recommendations from others.

you ought to get to know other charter boat captains, and see what they say. Competition is more likely to be cooperative than cut-throat, and in that business, you need the good relationships with the others. Think about the referrals when one is double booked or broken down.

Getting specific legal advice from internet forums is as bad as getting instructions for doing your own knee surgery.
