but according to an account I read, he stood back to watch the train hit his suv. I do understand that he may have had no idea of the result that would occur from his suv being hit by the train. Thus premeditation is hard to prove.<br /><br />Circumstantial is an important word here imo.<br /><br />Precedence from Scott Peterson being convicted on circumstantial evidence is important. We will see in Feb if Peterson gets death...and how that may impact the sentence that Alvarez receives.
