That would be late '70s and early '80s... To me, that's when the program was at it's best. I'm 49. I can't tell you the last time I watched a SNL. To me... it's just not that funny anymore. Steve, the key would be any witnesses you might get that seen it happen.<br />If not, I'm afraid you might be UTCWTP on this.

I don't know about you guys but I've yet to see a service station that didn't have CCT surviellance. Maybe, just maybe they got a tape of the crunch.<br /><br />Aldo

Steve good luck. How did the police write up the accident? Did they indicate that you were at fault or the other guy.<br /><br />I have found most judges take the path of least resistance. If you can get a copy of the report and make sure the report accurately reflects the events as they transpired. As that in most judges opinions reflects an unbiased third party evaluation, that usually rules the day. <br /><br />Just some random thoughts and good luck...

Whoa whoa whoa whoa....this changes EVERYTHING!!! You didn't say the other guy was driving a Toyota pick-up. I just can't imagine anyone having such disregard for a Toyota truck, as to drive it into a boat!!!! Obviously the other guy is incompetent! Prolly aught to have his license suspended!

I'm an honest person, and that's what happened. I explained to the cops that I pulled to up to the pump, put it in reverse, and backed up about a foot so the transom would be closer, and in that time he pulled up right behind me, obviously squeezing as close as he could since my boat was ocupying the bay and he had to squeeze in if he hoped the hose would reach his tank. The cop seemed to understand and never put the blame on either of us when speaking to me. I will see what the report says, hopefully tomorrow or Friday. What infuriated me the most about the whole thing was that there were other open pumps. This station has SIXTEEN pumps. He liked the one I was at though. Must be special. <br /><br />If he comes after me, and all indicators point to this being my fault, then so be it, that's why I insure (and insure well) everything I own. My mother is an insurance agent so I could not go without insurance if I tried, I'd hear about it every weekend! :D If anything comes of this I'll post it here. <br /><br />Thanks guys.

Most cases police do not determine fault, only report the facts from the scene ie:measurements, vehicle position, witness statements and drivers statements. The other guy has a good defense, he thought you were done as you pulled past the pump. He only saw your vehicle leaving the pump thinking you were done. The report will probably indicate you were backing unsafely simply because we are supposed to know what is behind us, even when idiots speed up on our back side and even if it would be impossible to know they were there. It should also report the other guy was following too closely and not paying attention. <br />Good idea to check the station camera if installed. You may need a court order to do it, but get that done. Most stores dispose of tapes after 30 days, some after 10.<br />The insurance dudes are the ones who determine fault, not law enforcement as most people think. It will probably be determined to be no fault, both insurance companies pay, both drivers rates go up.<br />Hate to be the bearer of bad news, just speaking from experience as a law enforcement officer.<br />Good luck!

Do they have a set-up where you can put reverse lights on a trailor? Sure would come in handy if they made it this way. Good luck Steve

If you have state farm and it’s your first accident if should be deemed you fault then they will forgive you the accident. He might have been tailgating you into the station, check the rule book on driving about him maintaining a safe distance. Even though standing still there are some standards,<br /><br />by the way,is it still good to go out in keyport,i'm about done with the 'paintbrush, and haven't winter the boat yet.

water has been rough past few days, but I was out last weekend and will be out again this weekend. :D I'll probably winterize 2nd week of Nov.

The guy is a moron. He couldn't reach the pump from where he was at to begin with. If he had and american truck, you guys would have laughed it off and there would have been no damage. <br /><br />NICE BOAT! good thing no damage or heads would roll.

12 footer, I almost crapped my pants here. <br /><br />First thing I saw at the bottom of the post was what I THOUGHT was ACTUALLY this guy posting a pic of his truck, with a hell of a lot more damage than I saw on it that day. Considering the facts known, without further evidence, I think you should minimize your problem by not aggrevating the adverse party. He may be stupid, but maybe not. There are plenty of scenarios whereby this could happen without there being any stupidity on his part, and it's moot anyway because stupidity isn't enough. It looks to me like you are past the pump so how would he know that you wanted to go back to it. He could have for example stopped and started looking for his wallet...or just plain froze or tried to reverse etc etc. There is no reason to think he was still moving when the impact occurred without some concrete evidence like an admission on his part or a witness since you were backing and did not see him. This is a minor... but a royal pain. This is what liability insurance is for. If you convince your insurance company it is not your fault they may leave the other guy hanging unfairly.
