You need to understand gun laws.<br /><br />A real property owner can threaten the use of deadly force to evict a trespasser from his own property.<br /><br />You CANNOT hold a person against their will, use terms like "freeze", "hold-it", or "don't move"... such terms when used in conjunction with a weapon are known as kidnapping and unlawful detainment.<br /><br />The trespassers won a court case that they had every right to win, and the defendant lost so he is using an asset to pay damages, which happens to be his ranch.<br /><br />I agree that the filthy trespassers had no right to be there.... but that doesn't give him the right to kidnap them and hold them against their will. For trespassing they were kidnapped at gunpoint.... which is the greater wrong here? Did his use of force match that of the perpetrator, no it did not!, it was Significantly higher.<br /><br />Know the laws, particularly if you carry or own a firearm, then make sure you remain within the law and STILL be prepared to defend yourself at risk of all you have.<br /><br />I'll repeat it so everyone knows.... you can threaten deadly force (show or point a firearm at someone) to evict them from YOUR PROPERTY (not from stealing or anything else, only to evict a trespasser) that you own.<br /><br />Sad story, but justice was served from the viewpoint of trespasser vs kidnapper. As far as their residency status, I hope that is the next case to go to court.

Good luck defending it in court.... and I certainly wouldn't do it at gunpoint.<br /><br />And an arrest for trespassing.... dont' think it'll fly. Maybe for a rapist or some such heinous crime, but not some guys walking thru the desert who cross a fence.

If they are trespassing, you can call the law and tell them, you can tell them to leave. You can not hold them at gunpoint till law arrives.<br /><br />Or, you can turn the dogs loose while you are "asleep" ;)

It shouldn't take a freaking Law Degree to live in the USA. :mad: <br /><br />I would suggest the ranch owner countersue for pain and suffering of having to kidnap these idiots.<br /><br />Ken

Note to self, buy several Large Dogs that like to eat raw meat :) <br /><br />He's right, can't hold them at gunpoint... you can point a gun at them and say "You don't belong here, LEAVE!!!!" But you can't hold them.

So, if a guy breaks into my home and I have a gun, I can't keep him there until the police arrive, I have to say, "have a good evening, ohh, and by the way, please don't trip on the door seal, you might sue me for my home because you might hurt yourself while ROBBING ME. Guys this is stupid. They should return the property to the RIGHTFUL OWNER, deport the illegals, and then... throw the judge out of office for the poor judgement call. As well as telling the NEW YORK news paper and its editor with the "poetic justice" socialist attitude. Man, I've got to stop... this is bad for my blood pressure.

Don, they did not break into his home, they were walking across his property. Big difference.<br /><br />What I read, he seems to be some kind of vigilante(sp) guy or something.<br /><br />If you would walk across someone's property and they drawed a gun on you and held you against your will, you would be pi$$ed off.<br /><br />I don't agree to the property deal, and if they were in fact illegal, then they should have been deported, not awarded.

It's our right, no our duty to be able to protect our property. Whether it's in, or outside our home. Just like it is our duty to protect our country. I don't need to have you read some very important documents to you do I? You know the rights for us to bear arms. Yes he had a felony charge against him, and should not "by law" had the pistol, but could you try to imagine what it is to live where he does. Out in the middle of nowhere. He didn't know if they had hostile intent. There is something else we haven't heard. There is always two sides of a story. We heard the "New York Liberal paper" and what the lawyers for the "illegal aliens" had to say, but we have not, I repeat NOT heard what he has to say. Have you ever heard two opposing sides have the same story. I haven't. I would like to hear his side of the story. Ohh, by the way, where did you pick up the word vigilante. From the "New York Paper"? Don
