First THEY say that GW is not doing enough to protect us then they send this 1000 lb gorilla back out to slam GW for doing it the wrong way. I daresay, when push comes to shove, that Bush's 'spying' will be proven legal and a prudent way to deal with issues at hand.

I too laughed at Gore. Is he all they have?

I also agree that it will prove legal... but I've addressed that in another post.

Consider the Emancipation Proclamation. How "legal" was that?

Al Gore is not a buffoon. The correct spelling of buffoon is T-e-d- K-e-n-n-e-d-y.

A-l G-o-r-e is the correct spelling of "Bozo."

Yer just gonna have to do better than that JT :p

Hey Dogsdad, how intuitive of you. When I first typed my headline, it was "How to you spell Bozo". Only at the last minute I changed it to Buffoon. :D

Re: How do you spell "Buffoon"?

Hmmm... Let's see

The FISA rules and court were set up in the wake of Richard Nixon and his illegal spying on political enemies.

It is clearly understood by most of all political persuasions that sometimes eavesdropping and wiretaps and the like are absolutely necessary. We needed a process of independent judicial review in order to permit legitimate uses while protecting average citizens against illegitimate uses (MLK was being wiretapped, fergawdsakes!).

They even recognized the need for speed, and allow 72 hours where the gov't can do whatever they want, and get a court order later.

So someone explain to me how it is legal to ignore existing law? And why not get a warrant if all is on the up and up?

Before you start painting someone with your two dimensional cartoon character brush, please explain to me why we should celebrate ignoring the laws of this country.

And remember, Bob Barr was a host of this conference where Gore spoke---hardly a liberal.

You mean this Bob Barr?

[note to boomyall, c'mon boomer, have you forgotten "I love California, I practically grew up in Phoenix." (DQ) or "I have made good judgements in the Past. I have made good judgements in the Future." (DQ) ;) I challenge you to find a better one on W's side of the fence]

Re: How do you spell "Buffoon"?

Ya, Algore had nothing to do with any of this

Clinton Administration Deputy Attorney General Jamie S. Gorelick: "(T)he Department Of Justice Believes, And The Case Law Supports, That The President Has Inherent Authority To Conduct Warrantless Physical Searches For Foreign Intelligence Purposes And That The President May, As Has Been Done, Delegate This Authority To The Attorney General." (Deputy Attorney General Jamie S. Gorelick, Permanent Select Committee On Intelligence, U.S. House Of Representatives, Testimony, 7/14/94)
In 1994, President Clinton Expanded The Use Of Warrantless Searches To Entirely Domestic Situations With No Foreign Intelligence Value Whatsoever. In A Radio Address Promoting A Crime- Fighting Bill, Mr. Clinton Discussed A New Policy To Conduct Warrantless Searches In Highly Violent Public Housing Projects." (Charles Hurt, "'Warrantless' Searches Not Unprecedented," The Washington Times, 12/22/05)
"One Of The Most Famous Examples Of Warrantless Searches In Recent Years Was The Investigation Of CIA Official Aldrich H. Ames, Who Ultimately Pleaded Guilty To Spying For The Former Soviet Union. That Case Was Largely Built Upon Secret Searches Of Ames' Home And Office In 1993, Conducted Without Federal Warrants." (Charles Hurt, "'Warrantless' Searches Not Unprecedented," The Washington Times, 12/22/05)
President Bill Clinton: "(T)he Attorney General Is Authorized To Approve Physical Searches, Without A Court Order, To Acquire Foreign Intelligence Information For Periods Of Up To One Year ..." (President Bill Clinton, Executive Order 12949, "Foreign Intelligence Physical Searches," 2/9/95)

Can't he still be a Buffoon?

I am pretty sure he'd remain a Buffoon if I invited him over to my house . . . Oh wait, that might make me a Buffoon . . . hmmmmmm. No, I'd let him come over, and I would be nice. Maybe he can come to iboats West? Does he have a boat? Do they make boats that combat Global Warming? Maybe he'd compromise his values just this once . . .

KaGee,

Noted, yet you are missing the point. The point is all of that stuff is OK for a Liberal Democrat, not an E V I L Republican.

If Nixon were a Dem. we would NOT be having this conversation.

PW2 - The decision takes 72 hours - the time leading up to the decision - paperwork, gathering of facts, presenation - takes 2-3 months. Their still has to be a burden of proof and that is part of the issue with FISA. How much burden of proof needs to exist?

Remember that FISA was set up in the days before the internet and cell phones.

Tomatolord

Re: How do you spell "Buffoon"?

Tomato,

You have incorrect facts. Those are not the parameters required. If they were correct (which they are not) why not go to the court and say "Times have changed, and we need X changes in it to make it usable" rather than simply ignore the law?

To the others, since when what some other entity does make any difference one way or another in when you need to follow the law.

It is complex law, and while I don't concede the Clinton admin did anything wrong, I don't know enough to say one way or another. In any case, it is completely irrelevant whether Clinton followed the law or not.

And one final comment. I don't understand why each and every one of you that champion your 4th amendment rights are so eager to give away all of your other rights? It baffles me.

Re: How do you spell "Buffoon"?

My rights are absolutely worthless if I'm dead.

But, living where you do PW, I can see how that would not necessarily a concern for you. Maybe if you lived only 50 miles from one of the largest muslim communities in the country
your thinking might change. Probably not.

In all this you or no one else can name an American citizen who's rights have been violated.
