And yes even though I was self employed I would most def. go to my lawyer (due to the points mentioned above about whistle blowers--as well as possible lawsuits for and against me) but the people in danger comes first.

non-disclosure agreements & confidentiality can't circumvent the law. Besides, it's not company data at all. Reporting it is breaking no laws, none that would hold up in court.

The right thing to do would be reporting to authorities.

Doesn't the company have rules for allowed computer use? Even now if the computer was reformatted and a reinstalled operating system, there is a way to recover it. I have personally recovered data from accidental formatting of hard drives. Your boss could into legal trouble for protecting or covering up that crime.

IT work is what I did for several years before I came to Canada to live, I would not be afraid of losing my contract in this situation because I would terminate it if the company took no action and I would action it myself.

How can any responsible person turn a blind eye to a child in danger? In such a case there is only one answer, Stand up and be counted!

I'd turn him in. He's a sick basstard for even looking at that stuff.

I work on computers part time if I found any of that stuff on one.

Not easy. The repliers agree that he should do the right thing, but they aren't the ones whose career may be at risk.

I would call my attorney immediately and get his help in reporting my findings first to the police, then to the company executives.

But it was easy.
I have reported bad activity (not child porn though), and lost my position for it.

Oh well, too bad. I felt just fine about it, as did my next employer.

And I never even had to testify at the criminal cases.

As others have said, children are at risk.

Your friend has to be able to look him/herself in the mirror at the end of day. Your friend will feel pretty crappy if next week they find out this guy abused a child.

I would already have reported it, and held my head up high as they repo'd my car, boat, house etc. if unable to find more work.

Your friend just screwed himself by protecting a criminal. That computer and any evidence is long gone by now, and he's still out of a job but with no proof to back up his story.
Had he called the autorities right away, his contract might still have been terminated but he could have teken it to court and won his case with ease.

I agree that your friend should have reported. Its simply right and wrong and we all know whats right here!

The other thing is your friend should not have even acted like he had seen anything, because like already said, they probably have trashed or burned the harddrive at this point. If he hasn't reported it yet, it still needs to be done, no matter the ramifications.

A childs security is more important than any job!!

He could have reproted it anonymously if he was that concerned about his own well being.

ok so i may be new to boat building but having a degree in international law may be of use here.
not many "everyday" crimes come under the umbrella of a general application law throughout the western world...... But this is one of them. unfortunately this is a common although hidden crime.
Although I know that your laws are different to ours here they mostly vary in the severity of the punishment. (with yours being stronger)
There are a couple of issues here that first and foremost have been ignored.

1) A non discloser agreement does not cover a crime being committed in present text or one about to be committed. Child porn IS a crime.

2) If the manager is stating that everything on the server-stand alone computers are confidential, that is because they are company property, therefore by stating that as a reason not to report it THE MANAGER is making the company apart of a crime and putting jobs, and other peoples welfare at risk by partaking to the crime. he is basically admitting that the items in question are company property.

3) Most fortune 500 company's have international ties and connections....... this could be a part of something much larger. when one is caught after a proper investigation by law enforcement it usually has far reaching implications that should never be ignored.

Now on to my personal opinion. By informing the correct law enforcement he is not a "whistle blower" he is reporting a very serious crime.
it is a bit different than calling in about the lady who throws the bag of dog poop out the car window whilst leaving the park.
Any manager that has put this gentleman in that position deserves to be sitting alongside the perpetrator of the crime whilst in court answering to his actions as well.

what I would have done is very simple.

A: told the manager to stay where he was whilst I called the police.
B: not touched anything further until the police arrived.
C: If put into the position where my employment has been affected negatively by my actions, is to phone as high in the company as possible, made an appointment and explained what is going on and ask why i have been treated as such.
should the outcome be a blow off i would report it to the media as no company wants any connection to child porn, as neither do people in general.

I can honestly say that this is a situation that should not have happened, had the manager acted in a manner befitting his position. If your friend reported it then he's done the right thing. At the end of the day people go to work to make money to enjoy life............. how can you enjoy life living with yourself if you didn't report it?

I feel for you and your friend bubba, this is the sort of thing that has no place anywhere and I can only hope that this is resolved for all parties involved and that the outcome is agreeable.

First stop, authorities. I'd start with the office of the District Attorney to speak with an ADA. While there, I'd ask whether or not it would be feasible to give the CEO of the company involved the courtesy of letting him know what has transpired. Although there is indeed a professional and ethical obligation to the company involved, the first priority is the indisputedly paramount civic duty in question here.

If he did not copy the drive all evidence will be lost! I'm sure the drive was taken care of by the General manager. It should still be reported so that there will be a case history for authorities down the road even if this one gets swept under the rug. Also so that the general manager can be held accountable for the cover up.

I have a two year old... just yesterday i was updating my knowledge of the list of sex offenders in my zip code. It is public information available online, free. Of the 13, in my zip code, 10 are listed for sex crimes against children. Every good citizen should check it out once in a while, especially if you have kids.

Your friend should consult an attorney! After he goes to the authorities.... then the media, if ignored!

On a more personal note Bubba: I would expect that this friend of yours will have some regrets later. I don't know how someone (who isn't a freaked out heinous pervert) couldn't be bothered by the visuals of running across child pornography. Keep and eye on him for a bit.

Should report it to police. He could also end up like a Joe Paterno after the fact for not reporting it.

The person in question could be sexually abusing a child, his child, a relative, a neighborhood kid or stranger.

Needs to be taken off the street.

Immediately report to authorities! I don't care how well a computer is wiped, there are always traces somewhere.

Just because someone says Independent Contractor doesn't always mean that is the case. Even with a contract the IC can be considered an employee of the parent company under certain conditions. I think there are like 9 test that courts use to determine if the IC is actually an IC or an employee of the company. I would immediately contact an employment lawyer to get advice on plan of action.

Yup....doesn't sound like you did anything....except come and gossip about it in here.

If you really believe this is a credible report, you have failed miserably....you should have called the police yourself.
If you aren't sure it is credible, why bother posting it in here?
