Re: Too Much Boat?

I'm guessing it's a mid-90's Silverton 310 Express, around 10K lbs fully loaded I'd expect. If he's in a 3/4 ton, with properly equipped trailer, then he's fine. If he's in a 1/2 ton, then he's likely over the limits of the truck, or at the very end of its capability.

According to NADA its 9500 without trailer or fuel. My bet it's over 12,000lbs easy.

That must have cost a fortune to get that rig cleaned up, hopefully his insurance denies the claim when they find out (if) he was over towing capacity or we're the ones who will be paying for it.

For the record, there is no such thing as "too much boat".

From working in insurance quite a few years, I can tell you with nearly absolute certainty they will NOT deny the claim. There is nothing technically wrong or illegal about it, as long as you are within your license and not towing commercially. Insurance is there to cover not only what other people do, but for your own stupid choices.

Agreed that the insurance will no doubt pay the claim if he makes one. However, towing illegally in this instance still applies in regards to damage/injury to others if it comes down to criminal liability. I'm no lawyer, but I could see someone being culpable if damages were sought due to an injury or death arising from towing a trailer outside the limits of your truck. Not to mention if he didn't have the proper permits to tow a vessel of that width.

Looks like there is a "for sale" sign up on the side window. Hard to tell since it is so small. Wonder if it was some guy who just bought it and decided to drive it home with his undersized tow vehicle.

Good catch. It looks like there's one on the rear window, as well.

No matter how you phrase it. Insurance will pay and the lawyers will be circling the scene.
Rephrasing the post for the opposite circumstances, it still reads true.

The insurance will no doubt pay the claim if he makes one. Even Towing legally still applies in regards to damage/injury to others if it comes down to liability. I'm no lawyer, but I could see someone being culpable if damages were sought due to an injury or death arising from towing a trailer even within the limits of your truck. Having the proper permits to tow a vessel of that width will not make you any less liable.

The end results remain the same. It is a no-win situation no matter what how legal you were, or not!
Be happy you are not That Guy!

Some of you guy's are worse than a 12 women sewing circle............

What really happened was, He is a member of the "Ohio navy" was on his way to lake Cumberland to meet up with the other members, the boat trailer is a borrowed one........trailer brakes malfunctioned due to long winter storage........driver swerved to avoid a misplaced Florida land crab and could not reel in the swaying boat.............

Sounds just as good as any other theory.......... now someone pass me the #2 sewing needle:lol:

I think some people come here just so they can argue with someone.

Interesting and that makes sense. I've always looked at it like this - if there is a large claim the insurance company is going to hire somebody to investigate and that person's job is to find a reason not to pay the claim. However I have no experience with it.
