Southwest Florida Manatee ALERT: URGENT !!<br /><br />U.S. Fish & Wildlife Service has scheduled another public hearing regarding newly proposed federal manatee speed zones.<br /><br />Place: Harborside Event Center<br />1375 Monroe St., Fort Myers. <br />Date: January 12, 2005 <br />Time: 7: 00 p.m. (doors open at 6:00 p.m.) <br /> <br /><br />A State of Florida court threw out speed zones in portions of Matlacha Pass when it found the zones were unconstitutional. U. S. Fish & Wildlife (FWS) decided to replace the zones and put them under federal jurisdiction. <br /> <br />John Kinney, Pres. Standing Watch, Scott Whitlock, Pres. Cape Coral Board of Realtors, Joe Mazurkiewicz, ALERT, Mike McCartney, Pres., CCCIA ask you to consider: <br /> <br />Why it is important to take this chance to speak out: <br /> <br /><br />• Why do we need speed zones that a Florida Court found unconstitutional? (Let's face it these speed zones have nothing to do with manatee protection. The only protection involved here is U.S. Fish & Wildlife protecting themselves from being sued by Save the Manatee Club again!) <br /> <br />• Did you know Save the Manatee Club is suing the State and Lee County to get the Manatee Protection Plan they fought so hard for thrown out! (What is it they want anyway?) <br /> <br />• Fish & Wildlife is considering assessing the cumulative impact of single-family docks and proposed Lee County as a preferred test case area? (It is nearly impossible to get a permit for a multi-slip dock & now they are going after our residential docks!) <br /><br />• FWC is setting new rules that limit the use of combustion engines. (Aimed at further reducing exhaust by-products. There goes your outboard motor!). <br /> <br />• FWC (with federal guidance) is working on rules to protect the current species? (Huh, you say? Well, it means they are working on plans to protect species before there is any known threat. How you ask? Simple, with more restrictions on access to public lands and waterways! <br /> <br />WE ALL NEED TO TAKE ONE MORE HOUR TO GO TO THE HARBORSIDE <br />AND SHOW 'EM WE HAVENT GIVEN UP. Rightfully, the attorney fees for the Schoonover decision should be reimbursed from YOUR BUDGET. (FWS) <br /><br />The manatee speed zones have been found "unconstitutional, arbitrary, and capricious " as ruled by JUDGE SCHOONOVER. This ruling was supported by the State court by not hearing the appeal. The Lee County LRRC (local rule review committee) submitted their report that there is no scientific basis for the emergency speed zones. <br /><br />Florida Statute 370.12. mandates the use of science when creating manatee zones, and provide a balanced committee of regional stake-holders to participate in the drafting of any new regulation. (Local Rule Review Committees) <br /><br />But this is just our State and Our People and our Constitution. I'm planning to rent a power boat sometime during my Spring vacation in the Sarasota area - how does all this Manatee business affect where you can and can't go? I know it's a hot issue with FL boaters, but I really am not up on the latest happenings.

Naples Daily News<br /> <br />BATTLE LINES DRAWN OVER BOAT SPEED ZONES IN LEE COUNTY<br /><br />By CHAD GILLIS, cegillis@naplesnews.com<br />January 13, 2005<br /><br />More than 100 boaters, marine contractors, public officials and manatee advocates packed a Fort Myers meeting hall Wednesday to spew their distaste for the U.S. Fish and Wildlife Service and its plans for speed zones on Lee County waters. <br /><br />Neither side in this contentious battle is completely happy with the federal agency responsible for protecting the nation's wildlife. <br /><br />Manatee groups want more protection than the federal government is proposing, while boating groups want to see the Fish and Wildlife Service leave boating laws to state and county officials. <br /><br />Les Hickman of Cape Coral summed up many of the crowd's sentiments. <br /><br />"Feds, please fold up your tents and go home," Hickman said as other boaters and marine interests cheered. "You're not needed and you're not wanted." <br /><br />Laura Combs, the Southwest Florida representative for Save the Manatee Club, said threats to the manatee population in Lee County are increasing while protections like state speed zones are being thrown out in court. <br /><br />The mere mention of Combs' name drew jeers from many in the audience. One lady at the meeting even called Combs "sick" for trying to protect endangered sea cows. <br /><br />"(The federal zones) need to serve as a backstop in case other protections are removed again," Combs said. <br /><br />Wednesday's heated meeting at the Harborside Event Center was part of the rule-making process for federal boating zones. <br /><br />The Fish and Wildlife Service first proposed its speed zones after a Fort Myers judge ruled several state zones in Lee County to be unenforceable in 2003.<br /><br />The areas in question include Estero Bay, Hell Peckney Bay, the mouth of the Caloosahatchee River and Matlacha Pass. <br /><br />Federal officials, in response to the local court ruling, adopted temporary zones to replace the former state speed areas. <br /><br />Fish and Wildlife Service officials are in the process of making those zones permanent. <br /><br />The federal agency has held a tight grip on the dock-building industry in Lee County after losing a court case to Save the Manatee Club. <br /><br />Although the U.S. Army Corps of Engineers actually issues dock permits, the Fish and Wildlife Service can keep permits from being released in areas it considers to have inadequate protection. <br /><br />Chuck Underwood with the Fish and Wildlife Service's Jacksonville office said the federal zones will become permanent on April 6 unless the state zones are re-established or some other action takes place to satisfy federal officials that manatees are being properly protected from boat collisions. <br /><br />"That would be a big help if the state were able to put their zones back in place," Underwood said. "We can't let these zones go away. The manatees are obviously there and the boat traffic is there too." <br /><br />Federal officials say at least 16 manatees have been killed by boats in the proposed zones since 1999. <br /><br />In related manatee news, Lee County officials met with members of the Florida Fish and Wildlife Conservation Commission on Wednesday afternoon to discuss the state zones that were ruled unconstitutional. <br /><br />Kip Frohlick with the state agency's marine biology department said the battle over manatee speed zones is even more complicated with local, state and federal agencies trying to interpret the Marine Mammal Protection Act and other animal protection policies. <br /><br />"It's been a conundrum from the beginning with the state zones, the federal zones and the local (court) ruling," Frohlick said, adding that the whole speed zone debacle is about as appetizing as watching meat get processed. "They talk about sausage being made, and this isn't pretty either." <br /><br />The state is in the process of developing a new set of speed zones for Lee County and soon will release a proposal for the revamped boating areas. A period of public comment will be followed by more meetings and an official state decision sometime later this year.

I'm not a tree hugger, but the crowd at the meeting seems a bit insensitive to me!

Carl, did you mean to say, seemed insensitive to you?<br />As in you were there and spoke/addressed FWS, and the crowd "seemed" insensitive to you?

What I mean is that from what I read here these people don't want to have to slow down for manatees. I hear so much about protecting the critters that this is just very unusual. I've never heard people act like this before. The pic I posted above was taken right out behind my house by my boat dock. I can't imagine anyone not willing to take it easy where mom and her babies hang out.

Well, it's all so complicated, so many special interestes involved, and so many related issues that go beyond the manatee issue that this cracker don't really care about what the SMC, Jimmy Buffet, the CCA, the FWC, local-yokel judges, and the FWS have to say... <br /><br />Lets get real here... This state is going down the tubes fast, but nobody wants to face that fact.. <br /><br />I do agree with the SMC on some issues, particulary the anti growth issue... IMO, there are enuff marinas, waterfront housing, developements & condos.. <br /><br />I'll agree that some boaters need to slow down a bit in some areas.. Whats the big hurry anyway?... Relax.. :cool: <br /><br /> I'll even go so far as to agree that there are some places where a powerboat has no business, but access by other means should not be restricted (for canoe, kayak, wading, fishing, ect.)... <br /> <br /> :confused: I just dunno who's "right" anymore...

What does Buffet have to do with boating in Florida? Do people really think that there are more boats in Florida because of Jimmy Buffet's Margaritaville song? How naive. How can you take someone who makes those kind of statements seriously?<br /><br />Besides, Buffet lives in Sag Harbor, NY. Does have a nice dock, though.

You guys can whine all you want about the animal rights groups. The main reason for the shortage in docking and launching facilities and the increasing number of boating restrictions is due to the phenominal growth rate in the Cape Coral / Ft Myers area and the number of boats that come along with all those new homes. Judging by the remaining number of vacant lots left in Cape Coral, this problem is only going to get worse, and Jimmy Buffett has nothing to do with it.

Mark, I gather that you have not been a boater for too long. Recommend you learn a little more before accusing the author of that article of being "naive". Google Jim Kalvin and read up on the man.
