Paypal Purchase Not Delivered Yet. How Long Before I File a Claim?

I agreed to purchase a used drysuit from a guy in Vermont and sent him the funds via PayPal on the 5th. Last Friday when it still hadn't arrived I emailed to ask if he'd had a chance to send it yet. No response at present. I emailed him again this morning and so far crickets. Should I file a claim or give him a couple more days?

If you want the item then wait a few more days if you can. Otherwise time to let PayPal take over and get your money back. I would look a the PayPal policies real close as well before I waited much more than 20 days (total) or so.

I definitely want the item. I'm sure he's just procrastinating. I have that problem myself. Thirteen days is a bit much though, especially since I emailed him Friday and he hasn't responded. For all I know he shipped it the day I paid him but it went to the wrong place or someone got if off the front porch. As long as he doesn't respond I'm in the dark which is unacceptable. I went ahead and filed a dispute which at this point is still between him and me but hopefully the fact that the communication is coming via PayPal will wake him up.

No, it's just a private individual. Found the item in a gear swap section. Though I've filed the claim there's still plenty of time for the two of us to work it out before PayPal steps in and hopefully that's how it goes down. If not I guess I'll get my five bills back and be out a dry suit. Rather have the dry suit.

I have had to file a few paypal claims over the last few years and I always get my money back or get my item, despite the rising tide against them, they actually do quite well at making sure you get your product or get your money back.

I've only had one issue but PayPal jumped on it and resolved it.

Worst case scenario is you get refunded.

I only had one occurrence when I didn't get money back and it was when I received some counterfeit software. What was amazing about that transaction was that the guy sent me the software on a CD-R and Paypal still wouldn't refund me the money....amazing!

All transactions involved E-bay as well so not sure if that helped.


One was for a set of Volvo Du-Props that had been repaired poorly.
One was for a set of Harley exhaust pipes that were all scraped up from the bike being laid down.
These were refunded, thankfully.

File the claim, if nothing else it gets the seller to respond. For all the crap I hear about Paypal, I've never had an issue with getting my money back if a deal went south.

I got refunded from pay pal a few times when I bought items on ebay and never received them

If I feel a deal has gone bad, I file a claim. That is why the systems is in place, if you are concerned, file the claim then work it out.

Don't know how you would file a claim.

You sent someone some money, and ??? what?



If this was a private transaction, no auction site, just something arranged between the two of you, then paypal has no reason to give your money back.

It's just like sending someone a check. Except you can't stop payment on it.


For all paypal knows, you sent money to your brother, now you want the money back.

Maybe I'm wrong, but someone is going to have to 'splain it to me.
Someone, please explain it to me.

You can file a fraud claim on any transaction that involves paypal, then they contact the person you sent the money to and allow them to answer, then they make a decision on who is telling the truth. If it does not go in your favor, you can appeal.

Well, that's news to me.

I new you could log a "dispute", which could escalate to a "claim".
But always believed it did not apply to money transfers, as in, you choose to transfer money to jon smith.
Thought it only applied to "online purchases".

I'm still wondering if this fits their definition of an "online purchase".

In any event, it may get the seller to get off the couch and ship the suit.

Incoop, please report back if this gets escalated to a "claim". And let us know how it turns out.

Wow! I'm glad to hear it, (serious) so many people I know have had horrible experiences, especially when it comes to buying vehicles.

If you used a credit card to fund the Paypal purchase, you can dispute it with the credit card company as well. I always use a credit card for all transactions I do.

Although if you dispute your credit card you are in violation of your agreement with paypal and they can close your account.

I research Paypal and it looks to me like sellers on Ebay have the most complaints about the System

Guys, here's how it works. You have 45 days from date of purchase to file the claim. Once the claim is filed the seller has either a set amount of time (I forget how much but it's at least a couple of weeks) or the amount of time the buyer waits before escalating. Once the case is escalated PayPal demands the seller either provide tracking information or refund the money. This is how it was explained to me by the little feller on the phone at PayPal. Roscoe, FWIW they do make a distinction between just sending money and sending money for a purchase. Thanks for the advice everyone. I did file the claim yesterday once I learned communication would still be between us unless he continued to avoid me.

And Bruce, I did use a credit card. Hopefully it doesn't come to that. I've been very happy with PayPal over the years. It's a great way to buy used stuff from private individuals all over creation.
