Yes your absolutley correct, now that Im done being quite so angry I feal pretty dumb about my reaction. Ive been a nice guy my whole life and I refuse to allow the other idiots in the world change who I am. Not to worry though it will definitley never happen like this again.

Sounds like a rookie captain on the other boat, or worse yet a drunk one. Get his registration numbers and sue him! Something of that magnitude should automatically be reported to the police....immediately! Glad you and your dad are ok.

Don't get this wrong, glad that nobody (innocent) got hurt, and congratulations to your bold decision to jump.

On the other hand, someone pretty much almost killed you and you did not file whatever there is to slow him down from hurting others? Geeeeeeee. Don't be surprised if you run into the same person again in the future, or this person into you.

Issues like that only occur because of stupid people. Too many out there, we have to keep hunting them.

The captain of the other boat is 100% at fault, if your lights were really on and legal. Less than 100% at fault if you had no lights or they were not adequately visible. You need to contact a lawyer, IMO.

Being stopped in a channel is not a permission slip for any boat to just run you over. If it were there'd be alot of people getting run over daily. If your lights were proper and lit, you had the right of way, period. You were not a vessel under power, so he is the give way vessel. Furthermore, even if you were under power, he hit your port side with his starboard, meaning he was still the give way vessel. Now, your delay in reporting the accident may not bode well for you. Did you get the offending boat's registration numbers? Any information at all?

In todays wired society with facebook twitter etc, you could in fact have everyone reading this post share and share again, causing it to go viral and affect his business. Perhaps then he may see fit to do the right thing so that this just goes away. Hit him in the wallet.

As A retired Coast Guard Officer I can say without reservation, the guy who hit you was at fault 100% Off the top of my head I can think of at least five (maybe more) violations of Federal law. Your only mistake (other than having a breakdown), was not calling the police immediately. I hope the FWC does a thorough investigation, and you should also report it to the USCG (the accident report will get to them eventually but will just be entered into the mass of data on other accidents) This guy needs to be written up! His boat is most likely USCG Documented and if he has any kind of license from the Coast Guard, he will probably lose it.
