Okay, I dont know what to do here. I was out on my boat when my engine quit on me. I was in lower tampa bay and had no choice but to paddle for land as it was getting dark and there looked to be a good storm commig my way. I turned on my lights and off I went. I made it about 5 or 600 yards and was almost across the channel when I noticed a much larger boat headed in my direction (my boat is 14 ft his was 36). I imidiatley bagan trying to flag him down hoping for a tow back to the ramp.I thought for sure they were going to stop to help as he was headed right at us. The other boat was about 20 yards away when I realized he showed no sighn of slowing down. As tough as the disision was( haha) my father and I decided we better jump. Good thing we did cause his starbord bow ripped right across the port side of my boat pretty much terring it in half. next thing I know Im looking for my dad and all I see is my overturned and now sinking boat. Fortunatley we are both okay and the only harm done is the complete loss of my boat. The guy did turn around and came back to pick us up but he realy did not want to call the fwc and just being glad to be alive I didnt push the issue. When my wife came to pick me up I realized my overturned boat could be a big hzard to others so I went ahead and reported the accident to the fwc and they said they would put out a nav. hazard warning and get back with me in the morning to make the report. The next day the officer called me and told me he would try tomake it up to my area (while I was salvaging my boat) to give me a self report to file with the state. Now I have been trying to talk to the other guy about at least helping me out with replacing my boat and he claims the accident was not his fault as I was stopped in the channel. I have never been so angry about something in my life. I spent the last two years rebuilding that boat and I only got to use it abou four times. I had no insurance on the boat and I just have no idea what to do.:mad::confused:

Holy Crap!!! I will be following this one...I think ya probably gonna regret not getting the law involved right away, Why wasnt he watching where he was going ? Was he drinking ?

The first rule of right of way, if you have power and they don't, they have the right of way. (think sailboats) Sounds like he is trying to cover his ***. I would have called the police immediately.

Sorry to hear you lost your boat. Glad that you and your dad are ok too. Not much you can do not having insurance other then get a lawyer and sue the other guy.

The first rule of right of way, if you have power and they don't, they have the right of way. (think sailboats) Sounds like he is trying to cover his ***. I would have called the police immediately.

You did not by chance get his registration number or know where to get it?

wow, man, yer lucky to be alive.

what a bunch of crum. it's the duty of any skipper to avoid an accident at any cost. even if it breaks nav. rules. you must do everything to avoid an accident. you were broke down and not under power. you couldn't do anything (except jump overboard to save your life). imho. the fault lies totally with the motor yacht. i can't even believe i read that he just run ya down... crazy.

i hope you find some kind of restitution... ya'd think if ya can afford a yacht, ya could afford to replace your boat, since he ran ya down.. creaton..

Im pretty sure the guy was drunk but no way to prove it now. In my defense I realy did want to call the law right away but try to remember I just came out of the water and had no phone. I wasnt exactly going to ask the guy to borrow his phone so I could turn him in, and I did call the law as soon as I got to the nearest available phone. I also must say I been in car crashes and motorcycle crashes and everything else and I have never been so terified as when I saw that 36 ft procat berring down on me like that and nothing I could do about it.My dad pretty much just recovered from a quad bypass and the worst part was thinking for a moment that my dumb!@# machanic skills could have just got him killed

Sounds like another guy running on auto pilot. He hit you so he is at fault. Only way the blame could be split is if it was dark and you did not display any lights. Also he is required under the law to report the incident even if you don't, I'm just surprised about the slow response from the local authorities. Just curious but did you have flares and horn and if so did you use them? I'm definitely going to watch this thread, good luck.

check your homeowner's policy; you may have coverage.

Encourage FWC to write the guy up fro reckless boating. As has been discussed way too many times here, there is no "right of way" and in every situation every boater is required to keep a look-out, operate safely for the conditions, and avoid any collision regardless of which boat has the duty to give way. You have a good case that he did none of those things. Plus his not wanted to report it after he sank your boat and nearly killed two people makes him look mighty suspicious.

I didnt get his regetration number but the closest place he could pull his boat up was at his own dock and thats were my wife picked me up. I went back the next night sneaky like to get the registration numbers off his boat but the boat is without numbers.

It might be CG registry boat and be registered by name not numbers. I would be camped out on the steps of the nearest CG station till they would take down full report. Also reporting to local Police, if he does not report this he is guilty of a felony hit and run, same as on a road. Get a lawyer, and quick!

Hmmm ...mmm, let's see ... a 14' boat not worth insuring, no injuries, so there's no money in it for a lawyer, so that's a non-starter. Rich yacht guy (with a lame excuse) vs. you = uneven playing field. He won't even report it to his insurance company as he could buy your boat many times over. You missed a golden opportunity to report the accident at the time it occurred, especially if he had been drinking. But, if you've got an honest face ... small claims court is an option. You guys dodged a bullet out there ... it could've been a lot worse.

At the very least he was guilty of failing to keep an adequate watch. Grossly negligent operation sounds about right too.

Okay update, I have had several conversations with this guy now and his thoughts are that he is responsible for about 250 dollars worth of damage. HMMM just rebuilt boat with a good running 60 hp motor and all the eqipment in my boat is worth 3000 to 4000 dollars from what my reserch finds. My attorney sent him a letter today to let him know we will be going to court. Its unfortunate and I dont like the idea of suing anyone but I just have to much work into that boat to let some idiot take it away like that. The fwc called me yesterday to let me know they have received my report of the accident and intend to begin an investigation Imidiatley. If nothing else I hope he at least goes down for not reporting the accident, wich he has not. Not saying anything about nothing but if any of you guys find yourself in the Bradenton Fl area needing a ride I would stay away from dream maker limos.
