Sorry...just sitting here fuming. <br /><br />Saw this on craig's list.<br /><br /> http://boston.craigslist.org/boa/112112176.html <br /><br />I was the first to call on it. Talk with the guy...he says it's mine..just come and pick it up. I explain that I have prior commentments in the morning..but I will be there around noon...as long as it is solid..I'll haul it away.<br /><br />I spend 2 hours this morning unloading my Silverline (project boat) and going over the trailer to make sure that it will make the 100 mile round trip. I call as I am pulling out of my driveway (about 11am) to make sure I have directions correct and he tells me someone else is on their way to get it...sorry. <br /><br />WTF?!?!? Ok...I understand that he needed this to be gone and he doesn't want to put all his eggs in one basket..but shouldn't he have told other guy that someone was looking at it already...and he can check back after noon to see if it was still available? I know "legally" I have no claim to the boat..but...I thought it was as good as mine. I really feel that this was a scumbag move on his part...am I wrong?<br /><br />-JMW

Seems a sheety deal to me. A call back (if he had your #) would have been appropriate.

It would have saved me the restore onthe silverline...just put the 65hp on it and go....<br /><br />He said that if it fell through with the other guy..he would give am a call. ARRGGHH. I just steamed cause I rarely find the good deals. Oh..well..I guess if it was meant to be...it would...looking on the bright side...I now can sand down and re-paintthe trailer <br /><br />-JMW

An oral contract is just as binding as a written one. As with any contract the interpretation is the primary consideration. When I first started to respond I wrote: A verbal....<br />The only difference between an oral contract and a written one is that an oral contract is harder to prove.<br />When written, a contract is only binding as to the language used. Same with an oral contract. If you want to enforce the contract you have to have corroborating evidence or get the enforcer of the contract to agree with your point of view. In the case of an oral contract anything you say can be contradicted by the other part, hence the success of finding redress is dependent on the willingness of the other party to acknowledge your contention. If you can get enough people to agree with you the contract might be enforcable providing that the two stories or interpretation are not divergently apart. I thank you.....

Sorry to hear, it sounds like this would have been a real find for you. This is just a case of a person with little respect for himself. Anyone who would go against their word for the sake of convenience (and hardly even that) is truely a flawed person. I have had written contracts nullified because they were not noterized. Our legal system is a quagmire.<br /><br />I have been told morality can't be legislated. I would probably need to have been there to know if this was immoral or just inconsiderate. Either way this guys word isn't worth spit. Good luck with your project just the same.

It is a good thing you called to verify the directions. Imagine how hot you would be after a 200 mile round trip. <br /><br />What model/year Silverline are you restoring JustMrWill?

The one in my sig...which was a free boat from craig's list...but it need a new floor and stringers...and re-do an a hull repair. ob ran and trailer is ok...so...if this hull was solid...I could either take my time on restore..of give silverline hull away.<br /><br />Thanks for the replies...I jsut needed to vent a bit.<br /><br />-JMW

What do you know JustMrWill, I have that model boat, a 17' Glassmaster model that I am currently restoring. Mine is a 1973. It's a great boat. I am sorry to hear about your misfortune.
