This past Friday headed down to the dock to spend another great weekend on my boat. At the dock there is seasonal slips as well as transient. So it is neat to see different boats come and go. Of course those of us with the larger boats are kept at the end since the water is deeper and weed free. The slip next to mine has a real nice Amber Jack and the owner is a real nice guy. He watchs my boat and I watch out for his as well as other boats there. Well on Saturday, my friend that has the Amber Jack needed to fuel up and change his prop that got distroyed. So normally we put our boat in the first couple of slips that is close to the bank. Fueling up a 100 gallon tank using 5 gallon cans equals a bunch of trips.<br /><br />Well Saturday in this slip next to my friends boat was a little 12 foot wood boat with a 30hp Evinrude. The guy had explained that this was the first time he has had it out. All the wood was like new. He really did a number 1 restoration. Well to make this story shorter, my friends boat came untied and the stern swung over and crunched the little wood boat up against the dock. I was sitting in my cabin watching my fishing poles minding my own business when I hear loud cussing going own. I look out my cabin door and see this guy about 6'6" 300 lbs, holding the end of my friends rope to the stern of the Amber Jack. So I walk down to see what is up. He was mad as all get out. He says, this blankity blank boat is in the wrong spot and has ruined my boat, I worked real hard for the last 3 years getting this boat to show quality and this sorry SOB can't even tie up his da** boat. I said please mister calm down, the guy did tie the boat up because I was there talking to him and watched him tie it up. It was an accident plan a simple.<br />So alittle bit later here comes the Ranger with the owner of the little boat. This rather large intimidating man had tears running down his face. The Ranger looked to see what damage was done. He couldn't see any, my friend couldn't see any, and I couldn't see any damage. Then the owner spoke up and said that he just assumed that there was damage due to the larger boat being heavier and its size that there had to be damage. Then he looked and reallized he had been crying in front of all of us for no reason. He was so ashamed, he loaded his boat up, packed up his camp and left. <br /><br />Would this be considered an "Act of God" since the rope untied itself? In Ohio if a rock falls off a dump truck and hits your windshield, it is considered "An Act of God" and you cannot hold the driver responsible.
