Re: eminant domain

The problem is not the Supreme Court ruling that allows the new e.d. changes. The problem is with the Senate. The term of a Supreme Court justice is for life, or until they are impeached by the Senate. When is the last time you heard a Senator use the words “Supreme Court Justice” and “impeach” in the same sentence? Why not?

Re: eminant domain

Eminent domain is for taking property at a set price to build roads or dams ,lakes andstuff like that.
Not for builing ballparks schools or taking a persons home so somebody can build a condo there.

Its all coming from there saying that persons one propeerty is bring in this amount of tax dollars,if we give that land to person 2 to build a hotel on it person 2 will contribute 10 times a s much taxes into the community, all of this is bull sh-t.

I thought ED was to help the good of the community.
If it would help, then condemn it and get it at fair market value.

I understand its supose to be for the good of the community, but were does it stop.what happens if you have a subdivision with 100,000 to 150,000 dollar homes in it,and a developer wants to build a shopping mall there why should the goverment or city officials have the right to take these peoples land??

Re: eminant domain

Here the city has started enforcing ordinances (after 20 years) against what they call neusence properties. Anything that they feel a neusance (sp) gets a letter and 5 days to change. If not the city goes in and cleans up.
With doing this they are holding health board hearings on many homes. If it doesn't pass their inspection they give the owner a few days to change it or face a large fine or they could of course sell the property to the city for next to nothing. The city will then burn it down, bury the rubble, and sell off the lot. Next problem, nobody can build there because of the expense of digging out the junk they have buried. Other problem there is not enough business in this town, nobody wants to build anything here so all of the rentals are being burned down. Their logic is the people who rent these older run down houses are poor, jobless people who do not contribute tax wise to the town.

The last homes they condemned were almost like your saying. One man was committed to a mental hospital by law enforement after he attacked me with a utility knife. He had definate mental health problems. The town took this chance to condemn his home, convince his brother who had power of attorney to sell to them for a buck, and burn his home down all while he was committed for his mental illness. On their side his house was gone, termites, he tore out all supporting walls and never replaced them etc.

Yesterday they found an older woman who has a disgustingly messy house. They committed her against her will through adult protective services to a nursing home and are going to burn her out in a few weeks.

The government stealing property is NOT RIGHT!!! It may eventually be good for the city, raise the tax base for the area, clean up the neighborhood etc. BUT the poeple they don't like in that neighborhood will just move to another hood and live there. Emenant Domain is there for the good of the people, roads, flood control etc. Not to build condos or sell off.

One more thing here a private group is trying. They have found out what everyone around here knows that there is an old Indian burial ground near one of the villages around here. They contacted the federal government and are trying to get them to condemn land under eminant domain and make it a national park. Isn't happening yet, but if it does it will take away thousands of acres of farm ground. Those farmers will fight that to the end.

E.D. is viewed by different folks different way. My Daddy was in the state senate in the early 60's when the Ross Barnette reservoir was built. It took in 33000 plus acres and displaced lots of people, churches, grave yards and such. He voted against it but its one of the top bass fishing holes in the state and the only water recreation in the central part of the state. To this day he still thinks it was wrong to have taken the peoples land by E.D. for that reservoir. It was initially built to supply water to the city of Jackson and they only started getting water from it a couple years ago when the Nissan plant was built.

We don't need the ACLU. We need to pressure our elected officials, Senators, to impeach the Supreme Court justices that voted for this, then over turn the SC ruling.

(And said with much sarcasm:) Hell, in the long run it’s easier to just watch Oprah and throw down some beers. It’s not like it’s my property they have their sites set on.

DJ, rodbolt agree 110% get out there and vote but you have to do more you need to get active go to council meetings. I'm a tax collector here in Jersey and I can tell you from personal experience that no one goes to the meetings, as a metter of fact when people do finally show up for those meetings you should see the council members scurrying around trying to find out what that person is there for.

It reminds me of the phrase.

"We have met the enemy, and he is us." Our inaction and apathy will be our doom.
