Re: Boating hangun carry laws

The current regulation by the CoE is under a temporary injunction out of the state of Idaho pending a decision by the court, so yes you can if it is not against the law by the state as well, mind you this is a temporary injunction pending the decision by the court.

The problem with this is that hopefully the ranger that pulls you over knows of this injunction. If you are a CCW permit holder and are not required to inform under state law then I would advise you to go ahead and carry and keep your mouth shut, but you are responsible for your own actions. Here in Colorado the lakes are patrolled by POST certified peace officers as Park Rangers. I have never heard of any CCW carriers ticketed for carrying on any of Colorado's lakes and I would know if there was at one of the more popular lakes in my Denver metro area, specifically our Sheriff supports 2A rights and is very vocal about it so I'm sure the Park Rangers know this.

But it is important that you get specific information on the lakes you boat on. Keep in mind that this is a very contentious subject, you are likely to get many many opinions on it such as you see here, but it does not end there, the law changes so much that officers may not know there is an injunction currently so while it may still be a law it cannot be enforced, so what happens? You get a ticket or summons, and you find out in court that you never should have gotten it, oh you pay your own transportation costs to fight the summons since you cannot sue the state for it, so most simply pay the summons/fine and move on. I don't know of any where that this is a misdemeanor charge but it could be, again I can only tell you about Colorado.

Now, even here in Colorado, if you choose to be a Dbag to the Rangers you will get charged for everything, including these BS laws, the idea is be a nice guy and be asked to put it in your truck along with the beer, and then come back out and have a nice day on the water, or you can be the other guy and get charged with excessive alcohol on breathe, trespassing (the gun charge), failure to observe safe boating laws(the throwable you didn't have), etc etc see what I mean? Leverage, exactly why People hate cops.

SO, better to ask the locals and don't be afraid to cite Morris v. US Army Corps of Engineers, D. Idaho, Jan. 10, 2014, just to help them out a bit, if you come off as a person who knows what you are talking about in a respectful way, you will have them on their heels, it won't be comfortable for them but believe me, they want to know because the last thing a cop wants to be is wrong.

Re: Boating hangun carry laws

my point isn't that a handgun couldn't kill a bear but rather that the chances of dying a horrible death even after shooting 10+ rounds are still pretty high.... personally I would MUCH rather shoot one through a high power scope on a high power rifle....

I have a cwp recognized in 34 states and no one ever knows it is there. No need to be where it is not recognized

Gun Laws By State

I know I carry an extra magazine, usually on boat / truck (whichever Im using at the moment), occasionally on me. I won't let an animal suffer even if it tried to attack, If I dumped my whole magazine into a bear, I will reload and put it down. I will track it to do so if need be.

A more practical concern--a group of us in a couple of boats were searched by game wardens during duck season. One guy in a small boat had an old Luger in his shell box. Because in a boat that small practically anything is "within reach", the warden said, it could be considered a "concealed weapon." No ticket from this younger warden who gave the advice quietly but his hard-*** boss, who was handing out tickets like a paper towel machine in a bathroom, would have.

That's one reason I got a CCP so I don't have to worry about not doing it "right" when I transport guns in my open SUV or small boats.

Keep in mind this practical advice: you can debate all day what the laws such as what is "concealed" means or the Constitution, but the only thing that matters is what the guy writing the ticket (or worse) says the law is. Better to avoid a fight than win one.

Good point and I agree but what I was saying is the shooter might still die... Bears are FAST and can do a lot of damage to you in the few seconds it takes them to drop.

Re: Boating hangun carry laws

Too much worry over something that isn't a threat. I've spent 40 years visiting the woods, lakes and mountains where bears, lions and now gray wolves live. Not once has one even come close to me, mainly I'm more of a threat to them than they are me. I know on TV everything sneaks up on you but in the real world when your aware it's not possible. You don't walk around like your downtown on the sidewalk trying to ignore everything around you. The biggest 2 threats of being attacked are by #1 other people and #2 other peoples dogs.

So how many of you have had a physical confrontation with people or an aggressive dog compared to how many have been mauled by a bear, lion or wolf?

Get your CCP load up, be aware and be safe.

Just told you I was 20 feet from a big cat,I don't think hiding in a tent is a good defense. He took a step toward me which was one step too close.I don't prepare for what is likely,I prepare for what is possible. Not the first time A big cat has investigated camp.

I think that's where the major disconnect is on the question and advice instead of answers. If you prepare for every "possible" danger you can't leave the house. What do you do to protect your family from falling pieces of Skylab?
