If her brother is 'out west' (I assume you mean in Alberta) He should send some $$ home to cover the cost of the dog murdering your home, unless he's spending it all on lifted diesel trucks, white Oakleys and narcotics...:/

Well the brother had an engine shop 'business' here that he was terrible at running, mostly because he's terrible with money, so I cant see a provincial change having much effect on how he operates.. he also ripped countless people off besides me, burned many bridges and friends here, and I think he 'ran away' to Alberta personally... She is technically a 'half' sister (different fathers) but the DNA they DO share is most defiantly off the whack job charts, she was always a bit 'better' than her brother.. (not QUITE as whacked) although he's older, so maybe with age she is going to be on par with him.. :laugh:

^ ya, tell me about it :faint2: I've got a decent amount of equity in my house/property, I'm even considering selling it this spring, and hell part of the reason for renting it was I simply don't need a 3 bdrm 2 bath house for just ME anyway:lol: (assuming she hasn't thrashed it too much and i can do a quick paint/touch up to make it look decent) take what i can out of it for profit, and live on the boat for the summer..:D then find a small place in the fall, for a good price, build a nice shop and be happy/comfortable..

There's nothing wrong with being a nice guy...and taking care of your friends is a reflection of your character, not a reflection of how bad a friend she might be?

I stand by original statement that "no good deed goes unpunished", as long as you have the right attitude and your eyes are wide open, so what!?

I have learned this lesson over and over, being "right" and legally being right are often times eons apart! I'm happy you guys have talked (amazing how this sometimes helps!) and you guys are at least on the same page as far as what's expected from each other (mostly).

If it were me...and the newest situation came up, and I had the abilities to help a friend, I would still do it...call me what you want, but I'm that kind of person. As Ghandi used to say....There is a higher court than courts of justice and that is the court of conscience. It supercedes all other courts.

After renting a room in my house and my guest house to my dead beat cousin, no more renting to friends or family. No good comes of it.

Whah wah wahhhh... "good grief!" :lol:

I ended up pulling the alternator off her car today, (of COURSE the belt is chewed to bits and needs replacing as well) brought it to a local repair/rebuid shop. Talked to her later on, she says she will try to 'pay me something' for my time, which is a decent gesture i suppose, but I doubt I will see it. No mater.. like I said, I am going to look at it as a favor to myself as well as her, to keep the peace for now.. and she made mention of actually getting the new job today, and possibly moving closer, to lessen her commute distance.. so we'll see what happens in the coming weeks..

I haven't even read the last 7 or so posts on this thread...and I won't read anymore. It is such a train wreck. The OP needs to stop airing this stuff on a public forum. If things get really bad for him legally, every word he has written here can be brought up in court. I don't pretend to know Canadian law, but I can just imagine the woman suing him for all kinds of stuff. Ambulance chasing lawyers are good for that. My last recommendation to the OP...quit posting info here and confide in your legal counsel. Internet lawyers are free for a reason. Good luck!

Just remember, " if it isn't in writing it isn't". Also put everything concerning "the arrangement" in writing!

Well of course that's my name! How are you doing btw Tim Frank? (Obviously we must know each other, being from Ontario right? :lol:) In all honesty, anything I have posted here could be brought up, sure.. but asking for a bit of help or advice is not a crime as far as I know... public forum or not. Not that I need to post anymore anyhow, as I feel the situation is working out.. thanks to all who replied. :)

For us here in the states (Michigan) what I do with my rentals is to only allow month to month signed leases (Lease is a must) with everything you legally can/should include in that lease. But by doing month to month, there was never intent of a long term lease. Then if he/she is late, the eviction process is quite short (less than 45 days). And don't download any lease off the net, they dare not useful and every state/country is different. Most land lords want long term leases, which will not make eviction easy, but check your laws, knowledge is power in your situation. She has spun every possible issue, and you are just way to connected to not act on this manipulation. You are a too good of a guy IMO, when it comes to land lords.
And the video walk through and appliance testing, is a must, both sides get a copy and both sides sign off on the contents. Sounds like you learned a bunch on this venture, but don't let it get to you, she could have made life much, much worse. I would consider a lease for the remaining portion of her stay, to protect both sides LOL at this point. If you can get her out, you should, the longer she stays, the less control you may have, and eventually need, in lieu of a signed lease.

If she refuses to sign a lease, for the remainder, what will you do? I think at that point I would for sure seek a lawyer, if not sooner.

Yes, I really have no choice but to try and look at the whole thing as a 'learning experience' at this point.. such is life right? Obviously we will never be 'good friends' as we perhaps once were, but I can deal with that.. there comes a point you simply have to look out for #1, and I won't feel guilty or bad about that. A lease will be the next step for sure..

Yup, that will defiantly be the lawyer up point for me, and get ready for a long and possibly expensive battle.. but i'm hopeful it won't have to come to that.
