It shouldn't even be in court. It would be like a NASCAR driver going to court because their car didn't pass inspection after a race.
Not to belabor the point - It is a dollars and cents issue. Four game checks worth for Brady. Sure, he can afford to miss 4 checks, but what about a rookie playing for a rookie minimum salary with the chance of having his neck broken or a higher chance of having his brains scrambled? It has become a matter of principle between Brady and the NFLPA trying to rein in Godell by curbing some of his unreasonable power.
This all ended up in the courts because there was no avenue within the NFL past a single appeal, which was denied by the Football Czar.
The only comparison with Nascar is Stewart being fined for making comments about safety. Inspections are done on every car before they take the track anytime and the standards are pretty much cut and dried.
