Like many threads, it can go a little off track. The problem everyone has is not with lawsuits in general. But these really unreasonable expectation type, frivilous, and ludicrious lawsuits. They eat up time and expense for the system. Anyone can sue anyone for anything. The problem is the cost to defend against the crazy stuff.

My children were in a school bus crash Memorial Day in 2008. You should have seen the stack of attorney letter and mailing we received. They are promoting this type of action. No, I didn't sue. My children had minor injury and recovered. They still have hesitation on riding the bus...especially without each other.

The boat accident happened Easter Sunday around dusk. The boat owner was supposedly not the operator at the time of the accident, but was one of the ones injured. The supposed operator did not survive. They keep mentioning that the boat was made to handle 12 people. They fail to realize that there is a weight limit as well. It's 12 persons or XXXX pounds. They were over loaded on both factors. Regardless, it is a sad story. http://www.news4jax.com/news/19304650/detail.html http://staugustine.com/stories/041809/news_041809_022.shtml

Wait, no off subject tirades here:

It is a sad story. Both from its beginning, stupidity and ignorance by allowing that many people to ride on the boat; to the accident and loss of life; to the ludicrous ending of trying to extort money from the manufacturer whose product performed as advertised.

Some of my fellow Americans have become ignorant, irresponsible morons. They fail to read the instructions. They fail to read the warning labels. They fail to use good judgment. And, when harmed, they sue.

Sorry to use the McDonalds case again, but she ordered hot coffee at the drive thru and proceeded to place it between her legs as she drove away. The cup did not melt, she squeezed it while driving. I know MCD was found responsible because the coffee was 190 deg. But, remember, water boils at 212. The auto-drip coffee maker and most old type percolator coffee pots have to boil the water to make the coffee. What I am missing. Maybe she should have sued the car maker for not having conveniently placed cup holders, or maybe her parents for not making her more resistant to boiling water. And, my wife will only drink coffee after the brewed coffee is microwaved even hotter.

My point, somewhere we have to stand up and accept responsibility for what we do, rather than blame our mistakes on everyone else.

Story: About 15-20 years, I worked for a construction company that built a courthouse in Chicago. The building was built to code and all project requirements. After completion and acceptance, the building engineer decided to close the outside air intakes during winter in order to save energy. He had to bypass mechanical devices installed to prevent this from happening. He was fully trained on the safe operation of the system but ignored his training. The building, not exchanging the inside/outside air as required by code and constructed by the contractor, developed a "sick building syndrome". Being full of lawyers, they all sued. My company, not at fault, agreed to pay $12 million to be let out of the lawsuit. As a friend always said, "it's not the money, it's the money"
