2004 mercury 25hp fourstroke dispute

Hello all,

I hoping someone here can help settle a dispute between my buddy and my uncle. My buddy bought a 2003 basstracker with a 25hp merc fourstroke on the back. The limit for most of the lakes around here (NJ) is 9.9hp, so my buddy decides to sell the 25hp, and try to find a mercury 9.9. The theory being he can adapt the steering and controls over with minimun hassle. My uncle in Virginia just so happens to need a 25hp motor, and while visiting him, I mention I have a buddy selling one. I explain to him that it is motor only, no controls or steering. The price is right, he sends me back with a check, I send the motor down to Virginia figuring I did my good deed for the week. Today my uncle calls me, telling me parts are missing from the motor. He says the motor should have come with the metal arms that connect to the steering. I think they attach to the motor with a ball joint, or something like that. My buddy thinks those arms are part of the steering, and not part of the motor. My buddy is willing to give up anything that should have gone with the motor, but he's not sure what should have gone with it. The question is, what belongs with the motor? Everything was removed where it attaches to the motor, the motor was removed from the boat, and that was that. If the motor was sold with no controls or steering, are there removeable parts that go with it? Thanks to anyone who can help me figure this out, I'm stuck in the middle.

The answer is how the engine was purchased. If it was purchased as a tiller steer engine, then all one needs is the engine. If was an electric start tiller steer then the battery cables should go with it. In this case the motor appears to be a console steer engine and as such it is useless unless a rigging kit was supplied which includes the controls and the steering link rod. Unless the seller made it perfectly clear that this was a motor only sale, all you are entitled to is the motor. If he was not clear in that regard, then the steering link and controls should have been included but that is one of those gray areas. You are buying used. Just like buying a used car, unless you check the trunk you may or may not get a spare tire.

if everything you posted is accurate then i'd say your buddy got what what he was told he was getting .
