Question on workmans comp...

Anyone here have the knowledge to tell me if deducting the cost of comp from an employees pay is legit??? I know it varies from ST to ST, but I think this is covered by some Fed. law I can't find. I will check with my State Dept of labor on this, just thought I'd get a few opinions if I'm way off-base.

in Florida, workmans comp is a cost of the employer, it is his insurance in case you are hurt on the job. so that you don't sue him and own his business. when i was in business, my insurance, liability, vehicles, workmans comp. was 40 % of the cost to do business. i would take my labor cost for a job, and have to add 40% to it to break even. i believe it is even higher now. and we did not have a health plan.

Paid by the employer.

If you want money from your employees to pay your bills, just cut their wages, then see if they stick around.

the cost of workmans comp, has driven a lot of employers to use independant contractors, but then the independant contractor, has to pay the workmans comp.

My sister is the manager of a $16 million account with a temporary staffing company here, which supplies the workmans comp. they supply engineers, to meter readers, to the local untility company. the temps can stay for 5 years. most are assimilated into the company. by using my sisters company the utility company actually saves money.

at the end of 5 years, they can move to a different job, in the utility, and stay for another 5 years, and so on.

In Washington you can deduct a certain % from their wages........
As an employer I have the option of being covered or not..........
It is soooooooo expensive that I don't........;)

Thanks for the helps guys...you were all correct...and, I was asking from the stand-point of being the employee.
I drive semi for a friend every fall and we haul just about everything.
I found from the KS dept of Labor that if my "Employer" owns the equipment, sets up the loads and pays me wages, he can't (in no legal way) deduct W.C. from my pay cut which is 27% of the gross for the load.
25-27% is the norm here for semi/tractor-trailer drivers and in my case, 8% has been deducted from my wages just for workmans comp.
This guy is a good friend, has no clue about this particular law and because of that, he owes me around 7k.
Where does a guy draw the line???????:confused:

Draw it now.
That's 8% of your money going to something you should not have been paying for.
Friends are one thing, but my livelyhood is another.
Food and shelter for your family is going to WC.
I would stop it now and ask for my back pay.
If he is true friend and was unaware of said law, then he should have no problem with that.

I can so relate to that!
When we owned a business in Federal Way and Woodmont with only one employee it was cheaper for both of us to make them/him a limited business partner. For the same reasons.
