new outboard extended warranty issue

Last October, I made a good faith deposit on a new boat (2004 Polar 2010) and a Yamaha F150. Upon going to some boat shows and educating myself on different models of boats and outboards, I decided to purchase from a local dealer even though I could have purchased the boat at a show or out of state at a lesser cost. <br /><br />One of the compelling reasons for me to purchase at the time was the fact that Yamaha was offering and extra 2 yr warranty on top of their standard 3 yr warranty for a total of 5 years. The dealer agreed to place their order and receive the motor within the time parameters (before March 31st, 2004) for this collateral benefit.<br /><br />HOWEVER, the dealer never received the motor until May 5th. Upon taking delivery of my boat, I was assured they would work the warranty issue out through Yamaha while I enjoyed my new boat. To date they have not resolved this issue with me and I am becoming concerned that the possibilities of reaching a resolution diminishes as time passes by. They mentioned the possibility of an in house warranty to remedy the problem but I am not really comfortable with that for a few reasons. 1. If I am away and need service to my motor, their in house warranty does not afford me any benefit. 2. If I decide to sell or trade the boat, the in house warranty will carry little or no value compared to the manufacturers extended warranty. 3. If the expense of repairs, service, etc. are coming out of their pocket, the appropriate service procedures may not be followed. 4. If I am not satisfied with their demonstration of service values, I am out of luck. <br /><br />I don't think it is unreasonable that the dealer should purchase the 2 year extended warranty for me or refund me the value of the extended waranty since these were the expectations I had when committing to purchase the boat.<br /><br />The boat has provided our family enjoyment throughout the summer but this motor warranty issue has compromised my satisfaction of getting the value of what I expected. Frankly, I am disappointed in the service values demonstrated by the dealership and indeed realize I may have been able to purchase the boat elsewhere with less hassle. How much longer should I tolerate this dragging on?<br /> <br />Helpful thoughts appreciated!<br /><br />Kevin

Upon contacting Yamaha, they informed me the dealer placed their order and received the motor after their promotion which expired 3-31-04 and suggested I direct my appeal to the dealer.<br /><br />I have e mail documentation from the dealer dating back to Feb. 2004 that the boat and motor were orderd.<br /><br />I certainly don't hope a major problem will occur with the motor but I want to have the confidence of knowing it will be taken care of within the next 5 years IF something happens. Afterall, isn't this the same reason why people have prenumptial marital agreements.<br /><br />Is this something worth getting a lawyer involved with?

Unfortunately, I think your time to act was before paying and taking delivery. <br /><br />With Yamaha giving you the brush off, and the dealer using your money to pay for his mistress, you can either forget about it, or file a small claims action for a cash solution. A lawyer will cost you more than its worth.
