Legal extortion. Thank god we have lawyers that saved me from hot coffee actually being hot. And for the public good mind you. The legal profession has found its way to a lower approval rating than used car salesmen. So much to be proud of. <br /><br />Let me see if I can help. Ice is slippery, Ladders + gravity can be hazzardous to your health, you can drown in a damp sponge, speed without control can end in injury or worse. Redistribution of wealth is socialism, the freedoms they claim to support are the ones that created this situation.<br /><br />Personal responsibility gone, we have a legal quagmier. Lawyers pleading cases against lawyers in a format proceded over by lawyers. Ya, the best there is but what a joke. Justice to the highest bidder or the deepest pockets or against those with the deepest pockets. Why don't we have $100,000,000.00 judgements for your day to day assault? Justice is for everyone, not just those with a legal edge based on financial risk/benefit anaylsis. And wrapping yourself in the protection of rights proclamation is just disingenuos.<br /><br />Our current system is nothing more than social welfare for the legal profession. Try and plead a legitimate case without the aid of a lawyer and prepare to lose. If you get heard at all. And if you win, dig in for your tiny little settlement. Where is justice for all? Our system is broken by those who are entrusted to maintain it. Sad.

The problem I have found with the whole lawsuit thing is that even when you have a real injury that was REALLY caused buy someone else’s carelessness or defective product your are just SOL<br /><br />There is no way to go through a simple process like a car accident and even collect your actual money damages<br /><br />Your only recourse is to use a lawyer and either this will get a settlement or you go to court if you really get damaged<br /><br />I am involved a lot with bicycles the biggest component maker in the word is a Japanese company that makes all kinds of items<br /><br />They make a lot of good stuff and they make a lot of parts that get recalled because they fail during there intended use<br /><br />I have a really big injury from one of there defective braking systems there method of operation is to use there giant size to just make it cost to much money to be treated fairly <br /><br />In my case only the people who ended up in wheelchairs were good cases to spend the money necessary to get a fair settlement<br /><br />Now remember I am not talking about people who went out and fell down BUT a real defective product that hurt a lot of people<br /><br /><br />tommays

If the guy loses the suit, he should have to pay Walmart's legal expenses...or better yet, make the losing lawyer pay them. That might put a stop to this kind of predatory behavior.

Thanks KIZ,<br />I've been to wallmart in 3 different states, and never saw a guard. Maybe it has to do with the area?

Kalian, You might also be surprized that the lots and stores have cameras, and trained security people. Many are plain clothed.<br /><br />No one has answered with a better way to settle disputes than the court. Still waiting to hear this.<br /><br />Easy to attack lawyers and some are bad but no more than doctors, police, educators, accountants and others, all of whom are tremedously costly when they act improperly.<br /><br />Without the stinking PI guys we would still have Pintos that explode, gas tanks would still be inside pickup trucks, asbestos exposure would still exist, OJ would have gotten away free, Enron would continue to steal, doctors could throw away their mistakes and on and on. They are very evil until you need one.

Quit blaming everyone else for accidents that happen....that is life. Where in the world did some people get the idea that everything has to be safe.....that's not right. My property is private.....guess what....someone might enter it and either find an un-safe condition or cause an un-safe condition for someone else....not my problem...guess what, if that happened I would do everthing to protect myself....transfer ownership of other assets to someone else, sell other assets to someone, quit working and plead poverty....anything to avoid paying morons for something they didn't deserve. How in the world can someone think that wall mart is liable because someone else came onto their property and broke the law....it is the law breakers responsibilty....not wal marts.....oh I forgot....the low life scum has no money.....so it has to be wall marts problem.....because they have money....time for jury's to wake up and say NO to this kind of crap.

Lets see tx, if the logic is followed through on this, and I get car jacked, I can sue the local law enforcement agency for a bazillion bucks over their negligence in keeping the roads safe?? :rolleyes: <br /><br /> Seems to me the guy should be suing the MURDERING KIDNAPPER for 10 million not Wally World. But I'm then pretty sure the convicted felon doesn’t have as deep a pockets as Wally World does. But if he did sue and win, then the MURDERING KIDNAPPER could sue Wally World for allowing the conditions in their parking lot that enabled him to perpetrate this crime in the first place. This may afford him the means for restitution to be paid to the original plaintiff.

There's a simple way to eliminate this problem. WalMart should simply countersue on the grounds that the husband willfully allowed his wife to be unsupervised by him and that contributed to her abduction an death, thus besmirching WalMart's reputation as a safe family store. <br /><br />Hey, it's just as bad as the original suit. <br /><br />UFM82
