Insurance claim-prop/shaft

Recently I hit something with my 1988 Four Winns Cuddy cabin. The prop was damaged and the motor was stalled. I had to be towed back in and after trouble shooting a few things I took apart the lower unit and saw that a bearing was seized in the upper portion of the lower unit and the gears were somewhat damaged. Progressive insurance has denied my claim cause they dialed my shaft and says it's not off enough to cause the damage. Although they can see where the oil/lube leaked out and cause of the lack of lubrication the bearing seized. Now I am stuck with 2600.00 worth of damage and progressive won't pay. I plan on appealing it but I am looking for facts to prove that this damage was caused. The boat was running perfect until I hit something. It's quite ironic it occurred at the same time and they dont think it's related. It had a aluminum prop and the shaft is steel so I feel that it could move the shaft one way or another causing the seal to leak but not necessarily bending the shaft. Any help or advice to argue this claim would be great. thanks

Well

I cant see how the drive was not leaking before the grounding to have bearing dammage in the upper


How much runout was measured :confused:


And a 1988 drive would have needed a couple of reseals buy now and many times at that age the shafts are groved to the point were even new seals will leak

That's Why it's Denied,....

Only because of the prop strike did you find the eminent failure of the rest of the drive......

Sounds like you're lookin' for a Free Ride......
