DOT Physical???

I was just told by one of my contractors that a new regulation recently went into effect- the DOT mandates a physical for all operators of vehicles when towing, when the tow and tow vehicle exceed 10,000 lbs. has anyone ever heard of this? i have no idea why the DOT would care what condition i'm in. if it's true, this would affect a lot of people, and it would be good news to pass along.

I haven't heard about the regulation, but if so would probably apply only to commercial drivers.<br />Health problems are suspected in the tanker that fell off the overpass onto I-95 in Baltimore recently.

http://www.fmcsa.dot.gov/ <br />Rule 390.3<br />I called them to ask., just out of curiosity.<br />After being transfered 100 x I talked to a very nice lady who thoroughly explained it to me...<br /><br />If you are not for hire and combined weight exceeding 10,000 lbs -nothing has changed at all. No DOT physical, nothing.<br />You can pull your boat RV, what ever all over creation and nothing has changed as long as you gain no income from it.<br />Weight does not matter at all.<br /><br />If you are commercial and combined weight exceeding 10,000 lbs (contractor, truck driver, professional boat racer that pulls own boat, mechanics road testing vehicles etc) you are and have been for quite some time covered by the rules of the DOT which require a physical and other provisions of the FMCSA.

More government intrusion! Where will it end? Next thing you know they'll be requiring commercial airline pilots to take a physical! It's a vast left-wing conspiracy instigated by the liberal media!

the guy i spoke to said it applied to private vehicles as well. i'll have to check it out for here in maryland. maybe a state dot rule. hope not.

These rules are not new. They were passed into law in 1992 just some of the states were noy enforcing them. Feds said no inforce then you don't need the funds for this, so states said we had better enforce them.

Federally it applies to any vehicle used in any commercial enterprise that is 10,001 + lbs GCVW. If you earn any income from that vehicle it is commerical.<br /><br />In the Peoples Republik of Maryland who knows what the rules are....

i found this statement on the maryland dot website:<br /><br />"Intrastate Non-CDL Drivers Information<br />Effective October 1, 2003, if you are a Maryland non-commercial driver operating a commercial motor vehicle in intrastate commerce (within the state of Maryland) and the vehicle weighs between 10,001 and 26,000 pounds, you are now required to hold a valid Federal Motor Carrier (DOT) physical card in your possession. If you are licensed prior to October 1, 2003, have a preexisting medical condition, and the onset was prior to 10/01/03, you will be exempt from this requirement for a 20-year period, provided your preexisting condition does not worsen. You are still required to maintain a DOT physical. <br /><br />This new Maryland law, requires any non-commercial driver, operating a commercial motor vehicle that meets the conditions listed above, to obtain and to maintain a valid Federal Motor Carrier (DOT) physical card in order to remain qualified to operate a vehicle intrastate in Maryland.<br /><br />If you do not hold a valid Federal Motor Carrier (DOT) physical card in your possession by October 1, 2003, you will no longer be qualified to operate the vehicle in the state of Maryland."<br /><br />am i reading this correctly? over 10,000 lbs and i need a dot physical, regardless of what i am doing?
