If the rating is 40HP the most you can leagly put on the boat is 40. The rating on old motors was taken at the power head so by the time you made it down to the prop you no longer had 40HP, new motors are rated at the prop so a new 40 will have more power then your old motor did when it was new.

The difference in ratings was about 10 - 15% an old 40 was about a new 35.

Craig

The rating information on the Coast Guard engine/passenger plate is a recommendation which some localities enforce. Check with your local authorities.

Here in Virginia exceeding the plate limits has no legal consequences.

Hi, Miloman.

The Max HP rating is what people who know a lot more about boats than you and I combined think is the most hp the boat can safely handle.

Some localities, as Mayflower points out, require that you follow that recommendation. Some insurance companies charge extra for overpowered boats.

It is not just a hp issue. Some of the new 4 strokes and DFI 2 strokes are too heavy for some boats that are rated for that hp.

In the case of your boat, rated for 40hp, I would stay with 40hp. If local law and my insurance company allowed, I might go for a 50 that is the same basic engine as a 40. Example would be the great OMC looper twins. 40 and 50 are nearly identical.

Good luck. :)

hey mayflower, are you sure? if so, what happens if you take an overpowered VA boat to florida (or somewhere else that does enforce the tag) on vacation? who's rule applies?

What kind of hull and how old is it? If you do overpower it I would have someone look at the transom to make sure it is in good shape first.

11

I assume regulations for the locality in which you are using the boat would apply.

Makes sense to me.

There are no federal requirements manadating the owner follow the rating. But as others have mentioned there can be individual state rules.

However, you could always get cited for negligent operation such as overloading (weight), or wreckless operation such as speeding, etc.

If you repower, stay with a 40 hp or lower.

Many states, insurance companies, and according to the Ontario regulations that I have in my hand all the provinces strictly enforce the max power ratings. Also, you may have trouble with liability issues and resale of your boat when that time comes. If you need more power, then get a boat rated for more power. Why would you want to put everything you have at risk for a few kph??

In other words, don't be a fool unless you want to prove you are one.
