I purchased a boat from Legendary Marine, the boat was being sold as a consignment. I spoke to the to the salesman extensivly about the motor and he stated that it was in perfect condition and that only a little paint was missing from the propellar and skag. I even had them perform a compression check on the motor.

Was this crack not visible when you first looked at the boat? or did you buy a boat sight unseen?

I agree there are lots of scummy dealers out there but buyers need to be responsible for thoroughly checking out any potential purchase especially if no warranty was implied.

sorry for your problem, but if you did not inspect and test drive before purchase. it's yours.

I was told by the salesman that the motor was " Like new ecept for a little paint missing".
Clearly this is a dihonest dealer

Don't confuse dishonest with uneducated. Could have been the same scenario had you bought it out of a neighbors driveway.

Come on guys. This is a professional boat dealer. They buy, sell and work on boats everyday.

They cannot use the "uneducated" defense. They looked at the boat to see that paint was missing and performed (allegedly) a compression check but somehow missed "extensive" cracks in the lower unit.

Even though it was a consignment boat they made some money on the sale and should be obligated to represent it's condition accurately.

Having said that, would I have bought a boat sight unseen with the party that stands to make money performing the compression check? No way, but let's not let the dealer totally off the hook. :)

Who says they actually did the compression test, this sounds like a lazy *** seller, depending on the costs of the boat, i would not let them get away with it.

i bet there was no cracks in the money you gave him keep at him to fix it if he wont call your lawyer get him to send a strongly worded letter they wont want the publicity.

No, actually it sounds like a lazy BUYER.

i bet there was no cracks in the money you gave him keep at him to fix it if he wont call your lawyer get him to send a strongly worded letter they wont want the publicity.

Yea and good luck with that one. AS IS means AS IS.;)

consignment sale, no guarantee, he did not buy from dealer.

No one has ask, are these "scratches" or are they cracks that go all the way through the lower to where it will no longer hold oil??

The casting on a lower is really stout and I just can't imagine anything being able to crack both sides unless it was totally full of water and froze and even then.

You sell the car, tell the buyer it runs great, he gets it home and finds the transmission is shot.

It isn't your car you just put it in your yard and sold it, how liable are you?

It is pretty much the same thing, if it had been a dealer boat they would have gone over it but the owner probably dropped it off and they put it out.

That is said and done and I don't know what can be done, now lets varify the damage and what is actually wrong with the boat.

If the yard owner says "my friend says it runs great but it's not my car so I can't/won't vouch for it" then he has no responsibility for the sale. If he portrays it as a "great car" I think he assumes some responsibility although I doubt that he is legally liable (I'm no lawyer).

In this case a boat dealer "vouches" for the boat and the buyer relies on what he believes to be a professional assessment.. I'm sure they can and will hide behind the "As Is", however, I believe the customer has a right to be unhappy. Overall, I think this guy is stuck.

point being he is where he is, lets help him get the boat going.

We really haven't even figured out what is actually wrong with it, it could very well be just scratches that won't affect the boat or it could actually have a bad lower, we need to find out which it is.

Jerry, start a new thread, and lets get the boat fixed. as you can see the consensus, is, that it is your problem. we have bashed this dealer bad enough. you haven't even told us what kind of boat or motor you have. please read this, before reposting, http://forums.iboats.com/showthread.php?t=250879

this thread is going no where, so i am closing it.
